Thank you for all the good advices. I fully understand and agree. I was not asking what you would do it should have done in this situation. I know the answers already.
This is just a hypothetical situation. So would you convict the homeowner had he shot the construction workers over perceived demolition? Given the Texas law allowing using lethal force.

Please help the wounded store owner who fought off 3 robbers. He doesn't have medical insurance.

From what you described, the house was, in fact, sold to another person.Stupid wrote:Thank you for all the good advices. I fully understand and agree. I was not asking what you would do it should have done in this situation. I know the answers already.

Even though he may have occupied the house it was no longer his property.
Even though the previous owner may not have liked the compensation it was sold so he is no longer the homeowner.
In fact, he would be trespassing if he stayed on the property.
Therefore, he had no claim to the property so he had no right to defend it with deadly force.
That is my take on it.

I wasn't arguing over it, I was funnin' with it.mojo84 wrote:The demo crew doesn't just show up on a bulldozer and start demolishing a house. There is a lot of work that goes on prior to the demo work starting. Electric and gas disconnected, appliances removed, verification no chemicals are inside, verification no asbestos is present, etc. Therefore, the hypothetical situation of a demo crew rolling up off the street and starting demolition is absurd and unrealistic.
Therefore, the hypothetical idea of shooting someone in such a situation is ludicrous and continuing to argue over it is also.
Re: Is deadly forced justified when construction company try
If it happened in this country with our legal system? Heck yeah. Texas law doesn't allow lethal force in that situation which has been the point of so many of the comments.Stupid wrote:Thank you for all the good advices. I fully understand and agree. It had been 3 days since the last post. Why bump it up just to post the beating a dead horse thing?VoiceofReason wrote:

Because I wasn't the one concerned about the beating of a dead horse and was fine just letting it die in the first place.

If you're beating the horse with a prohibited weapon and there is a 30.06 sign does it apply?

Can you shoot someone who is beating your dead horse? After all the dead horse is still your property and beating it can damage anything you choose to salvage like the hide. I'm sure the hide on a horse is with more than say $150 which someone had justifiably shot for. What about is this person is beating your dead horse at night? Surely you could shoot then.
