In Paxton versus the city of Austin, The AG Argues that the city of Austin owes $1000 for the first violation of the law, and 10,500 for each violation there after. It looks like he’s counting Each day that the sign is up as an individual violation. I haven’t figured out exactly the day that he believes should be used as “the first day”, Whether it’s 15 days past his cure letter or whether it starts from the initial complaint of a citizen. But in either case if his view prevails then the city of Austin is on the hook for well over $5 million at this point.
If you wait until the case of Paxton versus the city of Austin is finally resolved and Paxton‘s view of the law is upheld, then your county is almost certainly going to scramble to get those signs down before you can even get a complaint in.While having the signs come down is of course the ultimate goal, it would mean the county has escaped a financial punishment for violating the law for the last 20 or so years.
If you put in a complaint now that starts the gears of the OAG‘s office turning and at some point in the future he will issue a cure letter to the county but suspend enforcement pending the outcome of Paxton versus Austin. That will provide a starting point for calculating fines later if he chooses to pursue it.

Very much appreciate the explanation ELB. I just hate that Waller county appears to be celebrating a win, pending the final outcome of the Austin case (which can take who knows how long).
