I am not so sure it is hypothetical regarding Kagan. She has said during the interviews that she does not have an issue with the application of the death penalty. I don't believe her based on her previous cases and writings. Course - she is just practicing what is normal for the DC crowd - lie and say anything to get the big job - then you can do whatever you want...
