My main concern is will they require trusts to get CLEO signoff? If so, I won't be able to register any more suppressors or SBRs. Please show me one example of a trustee using a registered Class II item to commit a crime.

"Please show me one example of a trustee using a registered Class II item to commit a crime."
The best analogy I have read is that the new laws are like outlawing Model "T"s,
because they are being used in too many bank robberies as get away cars...

I haven't seen that worded at all as far a Leo sign off on trusts.

Why have we allowed someone to change legislation at his whim w/o the support of congress? He doesn't have this power.

Re: Executive order adds two new gun measures
You are correct. We have "allowed" it because congress obviously won't impeach him, which only leaves us with waiting for the next election or Civil War II, and the second option isn't worth it.APynckel wrote:Why have we allowed someone to change legislation at his whim w/o the support of congress? Edit: I forgot a 3rd option (really the 2nd option if waiting for the next election doesn't cut it): Secession. And not just grumblings and a opinion article or two... A proper secession, complete with formal letters to the POTUS from states' leadership, a withdrawing of representatives from DC, and kicking out federal agents.

Re: Executive order adds two new gun measures
The legislation isn't changing. The federal regulation is (probably) changing. The reason the regulation can change without Congress doing anything is because that's the way Congress wrote the law. The actual text of the NFA is 26 USC Chapter 53. The relevant part for transfers is 26 USC 5841(c), which states:APynckel wrote:Why have we allowed someone to change legislation at his whim w/o the support of congress? He doesn't have this power.
Emphasis mine. Congress often writes law that specifies broad powers but then leaves the details up to the agency that's tasked with implementing and/or enforcing the law.(c) How registered
Each manufacturer shall notify the Secretary of the manufacture of a firearm in such manner as may by regulations be prescribed and such notification shall effect the registration of the firearm required by this section. Each importer, maker, and transferor of a firearm shall, prior to importing, making, or transferring a firearm, obtain authorization in such manner as required by this chapter or regulations issued thereunder to import, make, or transfer the firearm, and such authorization shall effect the registration of the firearm required by this section.
On a slightly different angle, Tennessee and Alaska have state laws that require state and/or local CLEOs to sign off on form 1 & 4's submitted to them, as long as the person submitting the form isn't a prohibited possessor. Assuming this regulation change goes through, I think a similar law would be a good thing for the TSRA to push in the next TX legislative session. Unfortunately we'd have to wait two years in the best case, but it is a possible solution for us in Texas at least.

UPDATE today from the TSRA via email: (For those concerned about the affect on the CMP)
Information provided this morning by a CMP spokes-person:
"The latest Exec order, action, policy, or whatever it turns out to be has no impact on the CMP. From what we have read, the action applies to private importers. CMP has never imported a firearm and will never import a firearm. Any rifle we receive is transferred to us by the U.S. Army, who is not affected by the latest news. All of the rumors and reports were unfounded and were made without anyone verifying the accuracy of the reports with CMP. We will be sending a short and simple statement to all our constituents this week.
Thank you checking with us instead of just continuing to report our demise."
