Can someone from out of state open carry in Texas? My brother is cumming from Ma. and wants to open carry my 44.

No.

Open carry is only for CHLer. He can get out of state Texas CHL but that takes quiet sometime.

If Ma. is Massachusetts, AND he has a Massachusetts CHL (or a CHL from another state Tx has reciprocity or a unilateral proclamation for). I don't know of any provision in the law that would prohibit it solely on his not having a Tx CHL. According to the DPS' website, Tx has a unilateral proclamation with Massachusetts (Tx recognizes the MA CHL as valid, however MA doesn't honor Tx CHL's).

However, I'd suggest that he reviews Tx law before CC/OCing here; our laws may vary from what's allowed/prohibited in his home state.

And of course, if I'm wrong on his ability to carry here under reciprocity/unilateral proclamation, someone please correct me.
