IL: Brady loses another round

Again from Volokh Conspiracy, Eugene Volokh reports that the Brady gang had their federal lawsuit against the website Armslist.com tossed out by the 7th Circuit Court. Brady gang complained that Armslist facilitated the circumvention of fire arms laws by letting anyone find and by any gun anywhere, no questions asked, etc. They hung this on a case where one immigrant (alleges Brady) illegally purchased a pistol from a private seller and then killed another immigrant.
Both district and circuit court tossed these out, under Illinois law Armslist has no duty to police transactions between private individuals. Since the killing was in Chicago, apparently Illinois state tort law applied, even though it was in federal court.
