Illinois Concealed Carry Debate

Update on the debate going on in Illinois over concealed carry....
Meanwhile, the battle over concealed carry marches on in the state. Here's where Illinois' concealed carry legislation stands as of this week, according to the Associated Press:

Illinois Senate legislation touted as a compromise between Chicagoans weary of street violence and gun owners eager to legally carry concealed weapons elsewhere appears more restrictive than promised, according to a copy obtained by The Associated Press. It will be redrafted before it's even filed, a spokeswoman said Monday.

Sen. Kwame Raoul, a Chicago Democrat, had said the plan was a permissive concealed carry program. But the language indicates that Illinois State Police could deny permits to anyone unable to show they faced a violent threat or did not have a "proper reason" for carrying one -- hallmarks of gun-permit laws in states with more restrictive rules.

Raoul's idea was to provide better control over permits for carrying concealed weapons in Chicago and Cook County with a review by local police. Raoul said last week that outside of Chicago, the concealed carry law would require review only by the state police. Raoul described his proposal as "shall issue," a less-restrictive means of screening permit applicants.

It will be very interesting to see if this thing eventually gets passed and in what form. Looks like it got shot down for now due to an amendment added that essentially made the bill a may issue, rather than a shall issue. But, pro-gun lawmakers said they are going to massage the bill and bring it back for another vote.

Didn't the last judicial strike down of the IL law give them a timeframe to get an alternative passed? I thought that I remembered reading that the deadline was June 2013. If that is true, they are running out of runway. It will be interesting to see if they do get something passed and how watered down it turns out to be.

That is not shall issue. Shall issue means if you meet certain criteria you cannot be refused a license. With a name like Kwame, this guy is almost certain to be black. He should learn his own history. Having the local constabulary review one's application was how the southern whites disarmed the blacks before brutally murdering them.

I think that is why the legislation is going back for more work, rather than pass an aborted attempt that was essentially a "may issue" proposal. I don't know if he is ignorant of the terminology, or if he thinks that by calling it shall issue, it hides what they are trying to do, which is essentially keep Chicago and Cook County completely away from concealed carry. Methinks it is the latter....

I'm not reading it the way you guys are reading it. I'm reading it as Kwame wrote the bill as a shall issue WITHOUT that sentence in it....someone ADDED the part with the "must show" turning it into a may issue. I could be reading it wrong, but that's my interpretation of the article.
