Woooooo-hoooooo! Score one for the good guys. I hope he sues the pants off the warden and his agency. Those people burned him bad. I know if I had to do time when I was innocent, I'd be looking for compensation big time.

I hope he gets a nice 7-figure settlement and the two people that railroaded him lose their jobs and get personally held responsible too.

As long as the settlement comes out of the pockets of those individuals.

And not the pockets of taxpayers who have even less gun rights in HI.

It's OK with me if it comes from the taxpayers. Who do you think voted for the people that made all those oppressive laws? Who elected the people who appointed the officials that threw the prison guard under the bus?

In a democracy, the people are ultimately responsible for everything the government does.

Maybe if the taxpayers get hit with a big settlement they will think twice before they elect similar peoiple in the future.

The prison guard is one of those voters too so by that reasoning...

No. I think the government officials should have to handle this on their own without the taxpayers for backup.

Time to institute accountability in government, not just to the agencies, but to the individuals within those agencies. After all, it was an -individual- within the BOP that lied to the officials in Hawaii, saying the officer wasn't qualified to carry; it was an individual who fired him as well.

Hold the agencies accountable by all means, when injustice is caused by their policies. But when individuals within those agencies violate the law, prosecute them to the fullest, civilly and criminally. In this case, because the "policy" was already codified by law, it was an individual's decision that caused the injustice, and so that individual should be held fully accountable, without gov't bailout or backup.

The individuals involved should certainly be held accountable.

But realisticly, the individuals responsible probably don't have any money to speak of. So even if they are pauperized, the injured party won't be able to collect anything of significance.

In addition, while the individuals are directly responsible, the taxpayers (voters) share some of the responsibility as well. They are the ones who elected the fools who proceeded to appoint/hire people with bad judgement who then made some bad decisions.

I am of the belief that if voters do stupid things, they should be made to pay for their mistakes. Sure, people who voted with more wisdom will have to pay as well. But the hope is that by holding voters accountable, they will consider their votes more carefully in the future.

The voters of Hawaii have long needed a wake up call. Maybe this case could be the beginning.

My concern, honestly, isn't with getting the injured party lots of $$. He's already received his job back, plus back pay; the BOP has given him recompense commiserate with what he lost, IMO. I'm not a fan of large pay-outs to someone for being a victim; while I sympathize with them and want them to get back everything they deserve, I'm not gonna vote for them to get -more- than they deserve. The potential for large pay-outs has prompted many frivolous lawsuits, and should be discouraged, IMO (for example, the "McDonalds coffee lawsuit"). The practice has actually encouraged the mindset of victim-hood we see these days, by rewarding it through gross sums of money.

My focus is toward deterrence of future misconduct by individuals within government. Punish the individual, and his cohorts are a little more likely to actually obey the law, instead of making it up as they go along (coughcoughATFcoughcough). But if you allow the taxpayer to get soaked, then there's no immediate consequence for misconduct on the part of the individuals. The best way to deal with crime is to remove and punish the criminals, giving future potential criminals reason to pause; even honest folks elected to office by well-read, well-educated voters have turned deceitful, or been fooled into appointing deceitful people.

Now, if it was official policy that prompted this, policy in violation of federal law, then everyone involved in this from the BOP end of things should be hung out to dry, up to and including the agency. If it was agency policy that caused this, disregard my above statements; it takes a LOT more to "correct" a gov't entity as a whole.

My concern is in the area of punishment, vengence, and education.

I have no problem with punishing the individuals. The ones responsible for this case should be hit hard, IMO.

What I say is to fry the individuals and kick the taxpayers/voters in the teeth.

Not only will this be educational, but remember that the victim had to do a fair amount of time. Time is money. If I was forced to rot in jail over something like this, I'd sure want a good chunk of change in compensation.

So I personally would punish the people who made the bad decisions. I would personally punish the people who hired/appointed them, and I would whack the taxpayer/voters to try to knock some sense into their fool heads.

I gotta say spending 6 months in jail on bull charges is worth something,ok the guy got his job and back pay which he woulda had had he not been incarcerated,but developing a fear of taking a shower and dropping a bar of soap gotta be worth something

He was deffinatly wronged and I hope his deployment goes well and his civil case ends good on his behalf.
