Heller ruling out of SCOTUS today?

It's likely, given that it's the last day for announcements of the term, but you just never know, hence the question mark.

A great post from last night on what today's decision will portend.

No ruling on DC v Heller for Monday, June 23rd.

Last opinion remaining from March is Heller and the only Justice without an opinion from that session is Scalia.

Scalia would likely be the most favorable for RKBA rights if he rights the opinion -- while they all have to "agree" the writer controls much of the tone and specifics.

Next opinions: 10 AM Wednesday June 25th. Quite possibly there will be opinions released on Thursday if any remain then.

Yep, guess I misunderstood the "last day" thing - apparently it's more a "last week" thing. Fingers crossed for Wednesday!

Many people didn't know about this. Probably Wed or Thur, but they don't have to release it this session and might wait until October (IIRC) during the next session.

Like waiting on the results of the hardest test you ever prepared for thoroughly. We know it SHOULD be good, but cannot be certain.

I believe they have to issue it this session, but they have the option of extending the session by a day, days, or weeks, at their discretion. Most likely, the decision has been written for weeks and is going through proofs, analysis, and getting the final release ready. Hopefully, Scalia does write the opinion. I'm keeping my fingers crossed.

What really should have happened was the nine justices shaould have all hit everyone on the DC side with a big rubber hammer up-side their head and told them to read the second amendment because it says "shall not be infringed" and declared all infringements unconstitutional.

That is the way the supreme court in my world would work.

For many people the ScotusWiki page on this case will be more immediately useful -- summaries and analysis along with links to all the decisions and amici (amikee) briefs.

Hopefully this all will be obsolete in a few days though.

As far as why I believe the opinion has been written for weeks, I don't think the majority was on the fence on this issue. I believe they knew how they would decide before they heard oral arguments in the first place. Also, I am sure it takes some time to put together the opinion with the references, plus cross-checking it with the other justices. Getting it proofed, printed up, made ready for distribution, etc likely takes more than a few hours on the morning it will be released.

I honestly don't believe anybody not under a gag order knows anything for a fact. It's all speculation. Based upon the Brady's response to what was probably inside information, it seems as if it may be a good decision for the 2A.

Wow, Montana's not that bad after all.
Several politicians from the state of Montana, including the Montana Secretary of State, have signed a joint resolution asserting that, if the Supreme Court rules against an individual-rights interpretation of the second amendment, the compact between the United States and Montana would be violated, and that the state "reserves all usual rights and remedies under historic contract law" should that occur.

It doesn't look like the Heller case was released today :grumble

*edit* well I was right, there was no Heller decision decided today, most likely it will happen tomorrow though

They are waiting until the last day so that they can go into hiding if they need to.
