Benifit Auction

#1

Post by RetNavy »

next weekend is going to be a benefit held for a local CPS worker who is going through leukemia treatments. i was asked if i could donate one of my pistols and after discussing with my wife we decided on one that we bought for her and she didn't like very much.

my question is since i am donating the pistol do i need to go through an FFL and will the winner have to go through a background check?

the event is being held at the local Elks lodge which is also a 51% place, which i don't think will be a problem since it will be in a box with the trigger lock installed.

thanks ahead of time for all the input

P.S. pistol is a pearl handle Taurus PT100 .40 S.W.

RetNavy - That is a very generous thing to do. I can't answer your question, but here is a link to a previous thread, but
I don't think that there is a definitive answer. http://www.texaschlforum.com/viewtopic.php?f=23&t=8439
Personally, I wouldn't do it. I would probably sell the gun and buy a giftcard with the proceeds and let that be raffle prize. :tiphat:

I don't think you will have to go through an FFL, but I would make sure that raffle tickets are only sold to those who are,Texas residents, 21 or over. IANAL so that's just my opinion

I personally wouldn't do it but that is me. The other issue is the 51% place. Is there an exemption making that legal if it is locked? I would do as suggested and donate money and let the winner buy his own gun.
