Question while traveling

I have searched online but I cannot find any information on this..

I will be traveling in different states(Nebraska, Oklahoma and Kansas) with my girlfriend and she does not possess a CHL permit. I do however, but I will not be driving the entire trip and I would like to keep my gun in the glovebox or center console while driving as it is uncomfortable to wear on very long road trips. So my question is can she drive the vehicle with a loaded firearm in the center console as long as I have a valid CHL? I know this would not matter in Texas as it is legal.

Thanks! :fire

One very good place to start your research for each state is here: http://www.handgunlaw.us/

If I knew the answer to your question, I'd tell you.

Find forums like this one for each state and ask there. Just as you know Texas law regarding this matter, they will know their laws and can help you.

I would suggest you go out and buy a fanny pack for the trip. Gun stays on you COMFORTABLY, all the time. Yea, they're kinda dorky, but you don't have to wear it out in public if you don't want to. However, this keeps the gun clearly under your control.

That's what I'd do....

Go back to the forums index and check out the "Other States" section. In a sticky topic at the top, you will find links to many like forums in other states.

I use a free app called Legal Heat that list all gun laws for that state.

I just recently travelled in the same states you listed and had no problems. However, I think you should be aware of one particular part in the Nebraska law:
28-1212. Presence of Firearm in Motor Vehicle; Prima Facie Evidence.
The presence in a motor vehicle other than a public vehicle of any firearm or instrument referred to in section 28-1203, 28-1206, 28-1207, or 28-1212.03 shall be prima facie evidence that it is in the possession of and is carried by all persons occupying such motor vehicle at the time such firearm or instrument is found, except that this section shall not be applicable if such firearm or instrument is found upon the person of one of the occupants therein.
The thing is Sections 1203, 1206, 1207 & 1212.03 define firearms that are Machine Guns, Stolen, Defaced or in possession of a felon. So if the occupants of the vehicle can legally possess a firearm and the firearm is legal it doesn’t fall under this law.
From that, I think it would be best to keep it on your person if at all possible. I didn't find anything similar in Kansas or Oklahoma.

BTW, this is from http://www.handgunlaw.us

Have a nice trip.

I have on my phone and pad an app called CCW. icon is a pistol against a backdrop of the flag... has all the laws and listing for all the states... also has a section called transport laws.... cant remember if its a free app or not, but if its not, worth the low price.... its what i used when i traveled thru OK and MO a couple months ago.... also has a link to another app called Posted... shows anti gun and gun friendly establishments around your location... this one i know did cost , but rely on user input for the data.. One thing i can tell you about Oklahoma, not allowed to carry in buildings at rest areas

File this under "I learned something new today".
I never considered the possibility that a gun not on my body could be considered "in the possession of all occupants".

Thanks.!
