Im still waiting for plastic and im paying a ton of attention to signs. I didnt see a 51% or 30.06 sign. I asked an leo in the store if its ok to carry and he said no becauase they serve alcohol. I asked him about both signs and he had no idea what i was talking about. He then told me that you cant carry at any resturant that serves alcohol. Is there any truth to this?

Some advice, don't ask, don't tell. Learn the law, stay concealed.

The best thing to do is read the law, then ask for clarification here (after searching).

it's at this point that you know he does not know the laws and is giving you incorrect information. really kinda surprising for a LEO at this stage in the game.

In Texas, serving or selling isn't always a CHL deal breaker. Be cautious about other states though.

Ask an attorney "Is xxx legal ?" questions. My thought is the question to our LEOs is "Why am I being stopped ? " and Yes or No answers.

No offense meant to our LEOs --- IMO, their position is to enforce laws as understood. That understanding certainly varies due to the constantly changing and quite complex laws. Its not an issue of not trusting them-- its simply difficult to keep up.

I carried in a whole foods today. There were even things in there a thousand times scarier than my firearm. They are called liberal hipsters.

No 30.06 or 51% then commence to carrying (at Whole Foods). Period.

IF they ever posted one, just stop shopping there and go to Central Market...HEB is way cool on CHL.

You need to look at this topic viewtopic.php?f=53&t=34571" onclick="window.open(this.href);return false; and see signs 3 & 4. Whole Foods will have the blue sign posted, which is to be posted at any place that sells or serves alcohol but makes less than 51% of their income from the sale of alcohol. You can carry at these locations if there is no 30.06 posted. Sign 4 (red 51% sign) is posted at businesses that make more than 51% of their income from sale of alcohol for ON-PREMISE CONSUMPTION. These are bars and you can't carry there. A liquor store makes more than 51% of their income from sale of alcohol, but it is for OFF-PREMISE consumption, so they would have the blue sign and you can carry in a liquor store if there is no 30.06 sign.

The thing that scares me about the above is that a misinformed LEO may opt to arrest you for doing something that is perfectly legal. I know some laws are complex, but they should have at least a basic understanding of them if they are charged with enforcing them. In the case of 30.06, 51% etc. the laws are pretty clear...

If you just took a CHL course and you're not sure, you should review the laws themselves. You shouldn't rely on an LEO for legal advice, they aren't lawyers. Was he working as a guard, or just shopping?

I think the 51% issue gets way too many questions. A 51% establishment should be beyond easy to recognize regardless of a sign, and a grocery store won't be close regardless if they have a cafe' or not. Restaurants either. If a place of business is making the majority of it's revenue from serving booze to be drank on premises you'll know it 95% of the time. For the other 5%, you can look it up on TABC's website. The tax issue alone usually pushes a business to either sell less booze than food/other or go all out with booze sales. Being close can kill a business.

Review all the pertinent laws so you know without question. It may seem intimidating at first but it's really quite cut and dry.

If anyone needed any proof that just because someone is charged with enforcing the law does not mean that he necessarily knows what the law says, here it is.

Advice:

1) Concealed means concealed. Put it on, cover it up, and keep your mouth shut.

2) Don't ask, don't tell. Don't give someone the opportunity to tell you "no" and you will hear fewer of them.

3) Since the law stipulates that the signs you are to be concerned with must be displayed prominently, there is no need to go looking for them. Think about it: if you have to go on a treasure hunt to find the sign, it is hardly prominent, is it?

4) If it isn't an out-and-out bar, it is highly unlikely that the joint is a 51% establishment.

Perhaps you should review your class notes and your CHL handbook.

All kidding aside, you need to know the laws better than most LEO's. It is pretty cut and dried, and there are misconceptions held by non-CHL individuals.
