CHL Application Question

I'm applying for my chl in the near future, but have had some trouble in finding records of an arrest for a dui in 2001 when I was 17. I've called the city (Decatur, TX) municipal court, county clerk, and was ultimately referred to the city attorneys office. None were able to find any records on this. They could see where I was booked into jail, and was arrested, but nothing about the final disposition from the court. I remember paying a fine, and my licence was suspended. All three told me they don't keep records that far back. Do I need to include this on my application? Or since I was a minor, is it just not on my record? Any help would be appreciated, thanks.

You will need to get a letter from the court clerk stating they have no record on the disposition and include it with your application.

And that is the very weird case where there is one other place you might look. DPS may have a notice of the disposition in your driving records.

As I was typing this, I also realized that you said DUI and were only 17. That would be a class C misdemeanor ticket. Getting a full copy of your driving record from DPS would tell you exactly how it was reported to them. That may help clarify whether it counts as an arrest or not.

It is over 5 years put in your application they should not hold it against you

You must let them know about the arrsest and include any and all documents mentioned. At that point the DPS will ignore those and contact the same offices to get their own copies to verify. It should go through but it may take a little longer for the background check as they will have to get the documents from the local court.

Document it yourself, by hand and include it with your submission. I sent you a PM with additional details.
