The terminology police here will soon be berating you for not titling your post "negligent" discharge. Whatever... Tomato, tom-ah-to...(For fans of my current Avatar.... TOE-MAY-TOE). Clip, magazine... Verbal, oral... :yawn

Interestingly the story says the woman was shot in the "bu--". Not the most professional reference to the posterior. What's with people carrying these junk guns that go off when you drop 'em? My Raven and Jennings .25's, just have the CLIP fall out of them when I drop them. They never go off (so far).

Possibly it was the catching and not the dropping...

Maybe she was smoking.

The article says it was a Derringer so no magazine, but maybe it has a pocket clip.

"True story" from NC where I grew up...In the late 70's.

Two bums (homeless men) were in a Charlotte city park drinking from the same bottle of fortified wine. They got in an argument over who was having more than his share. One man pulled out an old, but serviceable .38 cal revolver and (according to him), dropped it. It then apparently (based on the forensic evidence) "went off" 5 times, striking the other man 3 times and killing him. The shooter (dropper) steadfastly maintained that he dropped it, and it went off... 5 TIMES.

Perhaps another reason drinking and carrying don't mix.

Double facepalm :banghead: I do so hate these news stories.

These are the tidbits that will get 30.06 signs erected even if it's just one restaurant at a time.

I understand your frustration, but thankfully a legally enforceable 30.06 sign is so large and so specific in its requirements that I've seen very few businesses get it right. Also with alcohol licensees getting required official signage from TABC, my guess is most establishments think they are barring CHL carry even when they aren't.

I have no personal reservations carrying past clearly non-compliant 30.06 or other notices. It is not my job to specifically discern every manager/owner/shareholder intent of their half-baked signs and cartoon pictograms. I follow the state and federal law as I reasonably understand it.

Derringer

That brings up something I rarely mention

Some (many) Derringers don't have trigger guards, some do.
I prefer a trigger guard.
Although this incident appeared to be a gun without a drop safety, Chron says it dropped to the floor and fired. or .... the lack of a trigger guard might have increased the chance the trigger struck the floor at an angle somehow ...

I prefer a trigger guard.

**Sounds like he pocket carried n a coat, unholstered maybe, since the gun "fell out" of his coat pocket while moving his coat ....

The reason for that is because many folks casually dismiss the event... and apply the all encompassing definition of "accidental" : An unintended event!

The purpose of CORRECTLY calling an avoidable incident like this one a "Negligent Discharge" is to assign responsibility to the person(s) involved. It is an important distinction!

Any weapon not secured in such fashion that it will not drop from clothing/concealment is clearly negligence. It is THIS kind of nonsense that really gains traction with the anti's, and rightfully so.

BTW, why are you dropping your Raven and Jennings? ;-)

I'm so glad the lady is going to be ok. Both parties will probably become the butt of many jokes.

In the distant future, after the jokes subside, they'll laugh about it in the end. :banghead:

I heard about this incident on the Radio while driving into work just now. The Radio "personalities" wanted to know why the guy had violated a No-Guns sign.

Yay, here it comes...

Clip and magazine are two different things.

A clip fully recesses into the weapon, where a magazine only partially recesses.

My XD-40 has a clip, which fully recesses into the handle of the pistol.

My AR-15 has a magazine, which extends past the magazine well.

I'll let you off with a warning this time, but the next Terminology Police Officer may not be as understanding.
