What and where does D.P.S. check as far as background

I had a misdemenor trespassing charge 13 years ago in colorado when I was 18, and it was just because of a roomate dispute, the only thing I've ever been in trouble for. I was wondering if anyone knew whether or not this was something that would get my application denied. Do misdemenors of a non-violent/non-drug or alchohol related nature from another state have any bearing on your application. I am supposed to take my class this saturday, and they do all paperwork there, and would just like to know if I should even bother if I'm just going to get denied, and loose the money I spent on the class, and application anyway. If anybody can help me out I'd really appreciate it.

Welcome to TexasCHLforum. Class A & B (and Class C Disorderly Conduct) misdemeanor convictions that are not for "family violence" only disqualify you for five years, so you will be fine. Be sure to list it on your application and go ahead and get the "disposition" documents to prove it was a misdemeanor, etc. DPS is going to ask you for it anyway. If the county clerk (or court clerk) doesn't have a record if it, then just get a letter saying they have no record.

Thanks that helps alot. Do you know when they will ask for the disposition? will I need it when I fill out the paperwork to send in with it, or do I have a little time before they ask for it, because I'm trying to get ahold of a copy of it right now, but I'm sure the're going to mail it to me which will take at least a week or two, and my class (in which I fill all the paperwork there, and they send everything in themselves for me) is this saturday.
Sorry for all the questions, but everytime I call D.P.S. to ask anything they never answer the phone, or transfer me to a different dept. where nobody answers the phone.

i might suggest that rather than your instructor send in your paper work, that you hold on to it until your disposition gets to you. then send everything to DPS. dont forget to send it "certified mail " as this will confirm delivery.

You can always hang onto your package after the class and send it when you have everything that you feel you need.

If you're thinking of sending the initial paperwork in as soon as you take the class and waiting for DPS to send a letter asking for the disposition from Colorado, I would advise against that approach. They will check with Colorado if you list it as a place of residence and a snag during the processing cycle will cause much more delay than if you wait for the information to build a complete package initially.
Your choice but I would wait especially if you've already requested the disposition.

I had an MIP on my record when I applied for my CHL. I listed it on the application but I never sent or had any disposition paperwork asked for. And it still only took me 45 days from mailbox to mailbox. Then again that was in 2006.

Get the disposition documents first, then send in your application. If you send it in without those documents, DPS will not ask for additional documents until several weeks later. Your 60/90 days does not start running until you give DPS a complete application packet with all required supporting documents. Sending in your application without the disposition documents would almost guarantee you a delay in issuance.

First post.
I took the course on 5/2/09, Tom Estep really nice person. I had to wait untill i had all my paperwork from the court house before i could mail everything in. They had no record on me from back in 1974, so i had to have the county clerk type up a paper saying so. Got all paperwork together and sent it off 6/5/09. I will wait and see what happens.
