Texas resident question.

How long does one have to be a Texas resident for in order to apply for a Texas CHL. The reason I ask is that my girlfriend moved back to Missouri for three months to help her dad open his new business. She's back now and is getting her TX DL this week. She had one, but got a Missouri DL when she went back because she thought she'd be there longer than three months. Anyway, I am taking my class on the 9th and she wants to take it also. Will she be able to?

Yes, she can. There is no longer a residence requirement to get a Texas CHL.

When she went in to get her Texas DL today they told her that they are switching to a new system and that it would take 6-8 weeks to get her new DL. So she decided to hang onto her Missouri DL, I told her that I believe she can take the class with an out of state DL, that she just needs to check the box that says something to the effect of she intends to make Texas her place of residency. Is this correct?

TEXAS CONCEALED HANDGUN LAWS GC §411.172. 3***

ELIGIBILITY

(a) A person is eligible for a license to carry a concealed handgun
if the person:
(1) is a legal resident of this state for the six-month period
preceding the date of application under this subchapter or is otherwise
eligible for a license under Section 411.173(a);
and
§ 411.173. NONRESIDENT LICENSE. (a) The department by
rule shall establish a procedure for a person who meets the
eligibility requirements of this subchapter other than the
residency requirement established by Section 411.172(a)(1) to
obtain a license under this subchapter if the person is a legal
resident of another state or if the person relocates to this state
with the intent to establish residency in this state. The procedure
must include payment of a fee in an amount sufficient to recover the
average cost to the department of obtaining a criminal history
record check and investigation on a nonresident applicant. A
license issued in accordance with the procedure established under
this subsection:
(1) remains in effect until the license expires under
Section 411.183; and
(2) may be renewed under Section 411.185.
(a-1) Repealed by Acts 2005, 79th Leg., ch. 915, § 4.
(b) The governor shall negotiate an agreement with any other
state that provides for the issuance of a license to carry a
concealed handgun under which a license issued by the other state is
recognized in this state or shall issue a proclamation that a
license issued by the other state is recognized in this state if the
attorney general of the State of Texas determines that a background
check of each applicant for a license issued by that state is
initiated by state or local authorities or an agent of the state or
local authorities before the license is issued. For purposes of
this subsection, "background check" means a search of the National
Crime Information Center database and the Interstate
Identification Index maintained by the Federal Bureau of
Investigation.
Aside from the officially documented requirements, you cannot get a Texas CHL if anyone proves you have ever uttered any of the following statements:

We don't keep firearms in this house.
Has anybody seen the sideburn trimmer?
You can't feed that to the dog.
I thought Graceland was tacky.
No kids in the back of the pick-up, it's not safe.
Wrasslin is fake.
Honey, did you mail that donation to Greenpeace?
We're vegetarians.
Do you think my hair is too big?
I'll have grapefruit instead of biscuits and gravy.

So I take that to mean that she is OK, as long as she intends to be a resident of Texas. It also sounds like maybe there is some sort of fee involved since she currently has a Missouri DL.

There is no extra fee involved. Just put the Missouri DL on the application instead of a Texas DL, and she will get a non-resident license.

Assuming she receives the Texas DL before she receives the CHL, she should probably inform the CHL section, because the Texas DL number is included in the info on the CHL.

At that point wouldn't her CHL change from a non resident to a resident? Would it be better to wait until she recieves the CHL and then make the change, or does it matter? Sorry, I'm not sure how the state does things in regards to this (or anything for that matter, just when I think I have them figured out...)

I applied for my CHL when I had my temporary Texas DL. The only issue I had was needing a picture ID to get the notary to stamp the CHL application. Since I have a passport it was no problem. I got my picture DL two days before I got my CHL.

Considering the delays I suggest getting started on the CHL processing ASAP and change the Missouri DL later.
