had to wait on NCIS check with texas CCW

#1

Post by bdhawk »

when i bought my last handgun, last month i had to wait around for a NCIS check even though i presented my CCW to the clerk and manager. it was at 'big r stores'. in dumas, texas.
i asked the clerk why, since i did have my current and valid CCW. he said it was ' a belt and suspenders deal'. just in case my CCW had been revoked and i had not had my CCW physically removed or i had not turned it in. the CCW was/is a third time renewal and the new renewal license was 'bout two months old. i was in the very first CCW class in my county, and was one of the first to receive texas CCW in my county after texas' inception of the law.

it only took a few minutes, and i choose not to make a big deal over it. i did not want to make it look like i had something to hide and arise their suspicions. it was the first time this happened since i received my CCW, and i really didn't like it. i liked the idea of the 'perk' of not having to go through the wait with a CCW. BTW, this was my second purchase of a handgun through 'big r', but this time they did the NCIS, too.

am i being a bit too thin skinned on this? has this happened to anyone else?

Never happened to me but I assure you, I would have had to want that gun awful bad to go ahead & buy it after that.
Walked on a used purchase about a month ago because they would not let me take it apart & check wear on a Sig 232.

i thought about walking, but i did not want to look like i had something fishy going on. also, this is the only stocking dealer in my town, and i want to keep a somewhat positive relationship with them.

I would have asked the clerk "what if the NCIS check is wrong?" The I would have walked out. If he has no faith in the validity of the Texas CHL , he would't get my business. That based on principle.

I went to a Wal Mart a few years ago and they wanted to do a check on me even thought I had my CCL. I told the clerk that I had already been cleared by the DPS and FBI and my CCL proved I'm not a criminal. I walked out. Unfortunately it was Christmas time and the gun was for my son who was about 14 at the time. No one else had it so I ended up going back. Well guess what? For some reason it took until the next day for my NCIS check to come back. The clerk that originally waited on me wasn't there when I went back. I never figured out what happened. I have never bought a gun from them since though.

I had to do a NICS at a gun show once but I'd moved a few weeks earlier and was still waiting for my CHL address change to process.

Great analogy!!!

I would have walked...If someone in retail who sells things like this and does not fully understand what the license is for and what it is supposed to do in situations like this, then I would walk and never come back to that store, ever...

There are plenty of other businesses that do understand and do a better job of supporting its customers than places like this...

I've done this before, and just when I think I'm making a good purchase with a vendor, and I hand them the license, and they walk a few steps away to make a phone call (instead of helping me get the paperwork "transfer" done)...I stop them, get my license back and walk away...This has only happened a few times to me...

I will not give any business to anyone in Texas that does not honor the CHL as it is supposed to due to "Store Policy" or some employee's idea that a NICS check "Should be done just to be safe". I just will not do it. :tiphat:

And.........I don't mind telling them so in no uncertain terms. :evil2:

How do you think they would like it if you said......
"Please give me a copy of your FFL license so that I can check the validity of it before I commit to a purchase from you" ?----- "just to be safe".

I'd have taken the time to verify that policy with the store/department manager before walking away. Stevie_d has it right. If they don't understand what the CHL means, and what we went through to get it, I don't want to give them my hard earned money.

It's up to the vendor. They don't have to take your CHL, they can as a convenience though. It wouldn't have bothered me.

It may be up to the vendor, but it is up to me if I want to accept that. I would walk away.

I would have in my case if it hadn't have been a Christmas present for my at that time 12 yo son. I was told at the time it was Wal Mart policy. I had a vendor at a gunshow try to call NICS a few months ago and I just set the gun down and walked away. I have heard of Academy doing it in Lubbock. But I won't buy from them either so I can't verify that.

Had to tell the lady three times at Bailey's in pearland that a NICS check wasn't required. She still, as in disbelief took, my chl and dl off to the other end of the store and asked some one else. :mad5 Made me furious, but I was picking up a gun that I had shipped to them to support the local gun shop and didn't want to pay another $75 fee to have it shipped to some one else. She eventually dropped it and didn't do the NICS so all was well. :nono:
