.22 MAGNUM AS BACKUP?

#1

Post by armedpilot »

Experts on CHL rules; a question-------- Let's say you are carrying a .32 caliber or higher handgun as primary, are you authorized to carry a backup pistol in say .22 LR or Magnum? Some of the NAA 's such as PUG and BLACKWIDOW appear to be a deep concealable backup JIC you need the little buck out of an ankle holster or vest pocket. :txflag: Thanks --- TONY

In Texas, when you have a CHL in the semi-auto category, you can carry any number or type of handguns you like.

I think there are a few states that restrict you to one handgun. You would have to watch out for that when you travel.

If the other state does not allow the smaller caliber then it would be illegal.
Reciprocity recognizes the permit to carry.
When you cross a state line you must carry in accordance w/ their laws.
That is why it is so important to know the laws of the state you enter.

Carry 24-7 or guess right.

Texas has no caliber requirement or limitation, except for the CHL shooting qualification.

You can see this for yourself. Penal Code 46.02 makes it an offense to carry a handgun on your person except blah blah blah. That means any handgun, whether loaded or unloaded.

PC 46.15(b)(6) says that 46.02 does not apply to someone who has a CHL valid and is carrying a handgun of the proper category (SA or NSA).

That's pretty much all there is to it.

I don't know about other states, though I can't imagine why they would have a minimum caliber.

However, now that I think about it, there may be some states that ban "Saturday night specials." You would have to be sure that you did not run afoul of one of those laws.

Texas law has its quirks, but our situation is much better then the patchwork of laws in most other states.
