New Resident CHL Question

Just relocated to Texas and I'm looking to obtaining my CHL. I'm all set to take my class, have a clean criminal record and was filling out the online application when I came to the section that says that I need to be a resident for six months prior to my application date. I've only been in TX for two months but I read on the internet that I can, if relocating to establish permanent residency in this state, qualify for my CHL. Anybody know for sure? I'd hate to waste the application fee only to find out that I was denied due to the length of my residency.

Rapid CHL for New Texans (HB 1704)"An oversight in the prior CHL law required newcomers to establish residency for six months before applying for a CHL, leaving them defenseless for half a year (see "Eligibility" under Government Code 411.172). This was changed to allow immediate application by a person who relocates to Texas with the intent of establishing residency (confusingly added to "Nonresident License" under Government Code 411.173; the six-month requirement remains in 411.172 and would apply to a person who moves to Texas without intent to relocate)."

"§ 411.173. NONRESIDENT LICENSE. (a) The department by rule shall establish a procedure for a person who meets the eligibility requirements of this subchapter other than the residency requirement established by Section 411.172(a)(1) to obtain a license under this subchapter if the person is a legal resident of another state or if the person relocates to this state with the intent to establish residency in this state."

Welcome to the forum IPLogged. IANAL or an Instructor, but as long as you plan to become a Texas resident you are good to go. Just make sure you have your Texas Drivers License for your class so you can get the Notary to sign and stamp your forms.

This forum has the best information on the current regulations. Also you can go to the official DPS website. It can be very confusing as to which laws are the latest.

Thanks, WildBill! I should've mentioned that I've already received my TX Driver's License. :hurry:

If you already have your TDL, you have established residency. There is no longer a 6month waiting period.

They apparently have overlooked changing that requirement on the website.
