Why do I believe he never would have had the cops called on him if he hadn't been advertising he was a concealed carry holder?

Then again. Why on earth was he taking it upon himself to play detective with a fellow citizen on the street? He is lucky it wasn't someone like me. I would have told him to go pound wood. If that was not good enough for him, he would have had a real problem on his hands.

:iagree: Unless you witness an action that puts lives in immediate danger, the best thing to do is be a good witness and keep your distance. I don't need to know if you have prescription medicine in your car.

Had he lived by the "don't start none and there won't be none" philosophy, he wouldn't be in the situation he is in now. But, he just couldn't mind his own business. :nono:

Isn't that the truth. This does not look like a situation where he was saving a person in distress. He was trying to be a narcotics investigator. He may walk but I bet he will be paying serious cash for the pleasure. Legal expenses add up quick for a criminal defense attorney.

No mention of alcohol as part of arrest.
Question if he was "impersonating" a public servant.
Since when is it illegal to carry a handgun in your pocket if you have a chl?

Who cares if he wants to wear a badge or not. Let's not find him guilty because he wears a badge. I think it's dumb to announce that you are carrying by having a badge but illegal??

I agree but apparently intoxication was not listed as part of the arrest. If the alcohol was not listed and no forensics done what do they have, a guy with a dumb badge around his neck, a gun in his pocket (legal for a chl) and the question of impersonating a leo. Seems to me that if the badge said "CHL holder" than he was not impersonating a "public servant". This will probably cost him a lot of money but from my limited legal experience I can't believe he will be convicted.

I agree but was that in the complaint? Are we all reading the same story here? I am just reading what was posted here and in the newspaper and I really couldn't find anything that said that the Badger said he was a LEO. We are dealing with limited info here and from what I could see this is a case of a guy wearing a badge that said CHL holder and his gun might have "showed" while at the carwash. Did the officer think that because a badge was worn that the guy was impersonating a LEO? The intoxication stuff and whatever else they have is not really reported. If he did say he was an undercover officer that would be bad news for him I guess. Not familiar with the law enough to say. But what is the lesson here? Non-intentional showing of your firearm is not illegal. Wearing a stupid CHL badge is not illegal. Of course, anyone can be arrested. If I were on the jury with what was presented here the guy would walk.

When I was a rookie cop in 1981, I would wear my badge off duty on my belt for the world to see. A friend of mine that had been around for a while pulled me aside and said the only thing you are doing is bringing attention to yourself. Attention is a bad thing.
The only reason CHL would carry a badge is to a) make folks think he/she is the police or b) you want people to know you carry a gun.
Both reasons will get you killed.

:iagree: It seems to me that the only witness to testify that Trujillo was impersonating a public servant would be the other person at the carwash who allegedly showed Trujillo his prescription bottles and tried to hide them. I don't think he tried to fool the LEOs into thinking he was also an LEO. If he has a good lawyer, I think he will beat it. I also hope that Mr. Trujillo lightens up on the badge thing.

Yeah... I agree. He will walk. His misguided attempt at playing DEA agent is going to cost him a few dollars for legal expenses but he will beat the rap. JMHO based on what I have read so far in the news on the story.
