YOU CAN NOT SHOOT STRAY ANIMALS IN THE STATE OF TEXAS. You have the right to defend yourself but you just can't shoot someone's dog because it is on your property


3) Shooting “stray” Dogs and Cats (Penal Code 42.09 Animal Cruelty). Any person who shoots a non-livestock animal, which includes any stray or feral cat or dog, and a wild living creature previously captured, can be charged with a felony offense. Penal Code 42.092 of the State of Texas law states that a person must have the owner’s consent to kill the animal (exceptions to prosecution are provided in Section 42.092(e)(1)). It is clear that a “stray” dog or cat either has no owner or that the person who shoots the animal did not get the owner’s consent.

...it's worth pointing out that this, which is being repeated in the thread, is not the law...it is parts of the law with comment by the website added in just in case we're not smart enough and need help understanding...by the website...

I wont shoot a dog coming onto my property unless it threatens my life. But dont come on my property to get your dog without asking permission or we will have a problem.

How do these dogs get shot ?? Do people come into your yard, jump your fence behind which your dog is contained, and shoot your dog? Do they approach you when you're out walking your dog on a leash, under your control and shoot the dog??

I don't have any pets, and don't have a problem with yours as long as you keep them restrained on a leash when you're out walking them (yeah, cats, too), as long as you pick up after them when they crap along the walking path, as long at they don't run loose and crap in my yard, and as long as you keep them quiet - most city ordinances have codes to control animal issues (dogs and cats), and if ya can't or won't follow the codes, then I just let the Municipal Court deal with ya - "Well, dogs bark, and that's the way it is" - OK, maybe after a $700 fine you can find a way to encourage the dog to stop barking.

And yeah, if your 65 pound pit bull somehow gets out through your fence that ya never take care of, and if he comes running and barking at me (I'm your next door neighbor minding my own business with an expectation that you'll control your dog) while I'm in my yard or getting out of my car, yeah, I'm gonna shoot him as soon as he crosses my property line and gets close to me to protect myself and my grandkids from a potentially dangerous, powerful dog that's running loose.

If I observe your dog crapping in my yard repeatedly after polite requests have been made to control your animal, you'll be scraping your dogs crap off of your front porch.

I am dumbfounded at the lack of respect many animal owners show for their neighbors. While my city unfortunately puts most of the onus on the victim to pursue animal control issues, I am happy to say that if the pet owner is non-responsive to Animal Control's requests, if the issue gets to Municipal Court, those folks don't take any lame excuses or give second chances - break the law the first time and you'll pay a hefty fine - for a second offense, the fine is extremely painful - most people get the message the first time.
