i totally agree. As an employer, I will can anyone carrying but me.... If you don't like it, look for a job somewhere else...Mithras61 wrote:The company does NEED probable cause, though. They can just demand that as a condition of your continued employment they get to search your vehicle. If you consent and have a firearm, and that violates company policy, then they can fire you.
If you have received a copy of the company policy, and it is written in compliance with PC 30.06, and the parking lot is posted as well, then you can be prosecuted for criminal trespass by a license holder, since you have received notice and the facility is posted (If the parking lot is not posted, you might maybe have an out, but I wouldn't bet my freedom & CHL on it).
If you are in a high-demand occupation, it may be worth your time to find an employer that isn't quite so rabid about it. Otherwise, it sounds like you may be S.O.L.
You may want to check the exact wording of the policy against PC30.06. If it doens't match up and the lot is not posted, you can't be prosecuted for having it in your vehicle (you can be fired, however).
If SB534 is passed into law & signed, they won't be able to fire you for THAT (but they'll likely find another excuse).
My property, my rules.. Even if they pass legislation otherwise, I believe we're in a "at will" state and I"ll just make up a reason for firing the employee...

1) SB534 wasn't about carrying. It was about employees with CHL's being able to keep guns in their locked vehicles in company parking facilities.linh811 wrote: i totally agree. As an employer, I will can anyone carrying but me.... If you don't like it, look for a job somewhere else...

2) Do you allow African-Americans to work on "your property"? How about the disabled? Do you pay your workers less than the state/federal mandated minimum wage? You should be able to, right? After all, it's "your property", isn't it?

If my home was also a workplace for employees of mine, I would administer it in accordance with the law. But it isn't, so I am able to exercise complete control over who is present at any given time and what they are allowed to bring with them.linh811 wrote:My place of business is also my place of residence. I LIVE where I work. I'm sure you'd be slightly uncomfortable with strangers (CHL holder or not) carrying in your home.
If you don't want your house to have the status of a workplace for your employees, obtain some other location for them to do their work at.
1) SB534 has nothing to do with carrying. It has to do with employees having firearms in their locked vehicles parked on company property.
2) Do your employees park their vehicles on your property? If so, do you claim the right to search your employees' vehicles?
3) If you don't claim the right to search their vehicles, how would you know if any of them are keeping firearms in them?
4) Do you provide protective services for your employees as they travel to and from your workplace? If not, do you plan to indemnify them if they are robbed or killed while travelling to or from your workplace unarmed - as a result of your policy?
You should plan for this you know. It could happen.
5) Do you believe you have the right to refuse to hire minorities or disabled people for employment on "your property", just because you also happen to live there?

I don't understand why you would have a problem with an employee having a gun in his/her vehicle. Since you're also a CHL holder, I'm wondering why you do not want them carrying on your property, especially if this is a person to whom you're entrusting your business.
If you don't trust an employee, why would you even hire the person and let him/her move freely about your property?
