To put more detail on it - "I know John is going to go rob that bank in an hour and I tried to talk him out of it, am I an accessory?"
Let's add: John is big and strong and I have no chance of stopping him and if I call the police, he will know who ratted him out.
I repeat - this is a hypothetical situation. The result of me thinking up odd questions and not knowing the answer.
I appreciate the replies.
On a thread about deferred adjudication I shared how a person I knew was told by a "friend" while sharing beers that he was going to rob such and such store, then laughed about it. My acquaintance took it as just talk. Well the no-good DID rob the store and was subsequently caught and the conversation came to light in the interviews. They came and arrested my guy and charged him with accessory because he did not call the police and warn them. He ended up taking deferred adjudication rather than face felony prosecution. A ruined record for not calling the police with something that MIGHT happen. Take that for what it's worth in this discussion.
