Eligibility questions

#1

Post by FNFan »

I am looking at getting my CHL and I'm confused by some of the language in the eligibility requirements. I pay child support and have for 12 years now but there was a time when I was out of work and I fell behind on my payments. I'm all caught up now and have been for years but I don't know what "has not been finally determined to be delinquent in making a child support payment administered or collected by the attorney general" means. Can anyone help me with this?

Also, in my youth I got two DWI's. One sometime around 1980 or 1981 and the other in 1985 or 1986. Problem is I don't recall with certainty when they actually occurred. It may seem strange that I don't know when they happened but we are talking about 30 years ago or more. It's ancient history that I just don't keep up with. How can I find out what to put on the criminal history form?

One last question. It seems that people on here generally apply for the CHL first and then take the class. Is that the normal order of things or should I go ahead and take the class first and then submit my application?

I will be grateful for any and all help. Thanks!

Welcome FNFan!

In answer to your questions: "has not been finally determined to be delinquent in making a child support payment administered or collected by the attorney general" means you are not making any attempt to pay. That does not apply to you, as you are current.

For your DWI offenses, if you remember what county, you can contact the county criminal court clerk and get a start. They may not have those records that far back, but they should know where to send you for them. If you cannot remember even that much, then put as much detail as you can on the application, and see if DPS asks for more. They might not.

It does not matter whether you do your application before, or after, the class. You DO have to complete the application before you can schedule your finrgerprint appointment. So, if you are going to a class that offers fingerprints in class, you would have to have done your application BEFORE the class to be fingerprinted on that day. Otherwise, you just schedule it for whenever is convenient for you.

Good luck to you! Here is to a smooth process!

I can help with the DWI dates. I forgot when I got mine (also in the early 80's) and had to pay for my driving record from the state ($7.50). That way I could contact the county courthouse, give them the exact date, and they could send me the pertinent documents showing that I successfully completed probation.

Go here and order the "Type 3" record: http://www.txdps.state.tx.us/DriverLice ... ecords.htm

I can't help with the child support issues though.

Thanks for your help! I have one more question. Now that I have the driving record and an idea of the dates involved I contact the County Clerk and ask for certified copies of the charges and convictions, is that right?
