Hub hyndai
Hub hyndai in Houston has a notice about no concealed carry. Informed the manager that I will not be purchasing a car from them and walked out...
Of course that was after I showed him my approval paperwork from the bank. He was not happy.. He was trying everything to get me back in the building.. Told him I would, but since I am carrying, I don't want to break their rules. Bye...

Elaborate on notice. Was it a 30.06? If not, you wouldn't be breaking any rules, laws, or ordinances. The manager probably didn't even know the sign was there; it might've been a poorly translated Korean sign. And I wouldn't have mentioned that I was carrying. All you need is for the guy to call the police and say that you were argumentative about the company's policies and told him that you had a gun.

...you did it just right...don't let anyone talk you into living in the "what-if" fearful land of Oz...if the guy wants to file a false police report, and lie on the stand...that's HIS problem...you stood up and said your piece and stood up for all of us...thanks for doing so...then you took your money and left him with his mouth hanging open and his sales further down for the month...he may not change...but he won't forget!!!

It's always a dangerous thing to out oneself to a stranger, especially in the course of conflict. One could certainly make the argument that if you were arrested and and testimony were brought against you it would be a problem for you. So often all people hear when you're talking is, "Blah, blah, blah, blah, GUN!!"speedsix wrote:...you did it just right...don't let anyone talk you into living in the "what-if" fearful land of Oz...if the guy wants to file a false police report, and lie on the stand...that's HIS problem...you stood up and said your piece and stood up for all of us...thanks for doing so...then you took your money and left him with his mouth hanging open and his sales further down for the month...he may not change...but he won't forget!!!
"Officer, he came in, argued with me, he was angry about our store policy, he said that he wouldn't come back, and oh yea, on the way out he told me he was carrying a gun." You have to ask yourself if you would want this TRUTH to be conveyed to a police officer, and a local television reporter.

Concealed is concealed. I wouldn't make a fuss over it. Leave these people in peace to their false ideas that they are protected.
Might have asked if a gun holster for the driver's seat is an available option :-)

OK, so what would be the charges? I guess our perjuring car salesman could say he waved the gun around, but presumably he could make that argument about anyone that came in the store and didn't buy a car, regardless of whether the person had a CHL or not.Embalmo wrote:It's always a dangerous thing to out oneself to a stranger, especially in the course of conflict. If the store employee was really mad, he could have said that OP killed a homeless person because he was upset that he couldn't carry a gun in the store. I don't know about the rest of you, but I'm not going to risk taking the "ride" for murder... Just buy the car!

Would verbally outing your CC to someone be considered intentional failure to conceal? If so, then there's the charge.ScottDLS wrote:OK, so what would be the charges?

No, it would not.RottenApple wrote:Would verbally outing your CC to someone be considered intentional failure to conceal? If so, then there's the charge.ScottDLS wrote:OK, so what would be the charges?
Note that the offense occurs when one "intentionally fails to conceal the handgun". It says nothing about intentionally failing to conceal the fact that you have a handgun.PC §46.035. UNLAWFUL CARRYING OF HANDGUN BY LICENSE
HOLDER. (a) A license holder commits an offense if the license
holder carries a handgun on or about the license holder's person
under the authority of Subchapter H, Chapter 411, Government Code,
and intentionally fails to conceal the handgun.
Facts are stubborn things; and whatever may be our wishes, our inclinations, or the dictates of our passions, they cannot alter the state of facts and evidence. - John Adams

Re: Hub hyndai
Maybe I'm missing something but taking the OP at his statement, he did not say he was "carrying a gun" simply that he was carrying. They're not the same. He could have been saying he was carrying his wallet, the letter of loan approval from his bank, or any number of other things. I know it's just a word, but...anyway, I think he made his point by making his statement to the manager and walking out. Good Job1

Re: Hub hyndai
My interpretation is that telling someone that you have a gun is NOT failure to conceal, because the gun's presence was not discerned by "ordinary observation" (at least no more so than I discerned Bin Laden's location because the news told me about it).RottenApple wrote:Would verbally outing your CC to someone be considered intentional failure to conceal? GC §411.171(3) wrote:"Concealed handgun" means a handgun, the presence of which is not openly discernible to the ordinary observation of a reasonable person.

Re: Hub hyndai
I never even tell them I am carrying, only that their wish to prevent law abiding citizens from shopping there is noted and I will obey it, along with every person I can influence similarly.
They have made their wishes known, that's all their is to it. Given the recent example from Philly, all it would take is someone in the dealership to notice your gun while you are cliumbing in and out of a car and call the police, combined with a cop that does not understand the law, and away you go.
Sorry, ANY sign is an expression of anti-rights wishes: If it's up there by mistake, they can rectify their error by taking it down; if it's a "wink, wink, nudge, nudge" at making the anti's feel good, they should try making the law abiding feel good by putting up a sign that says "No weapons allowed except for those legally carried by law abiding citizens"; and if they mean it, then they should comply with the law and put up the right sign. In the meantime they can do without my business.

Welcome to the Forum!
That was a sign telling you not to buy a Hyundai! I'm sure there is a Ford dealership down the road that would welcome you, your money and your 2A to their place of business.
Seriously though, I think you handled the encounter well and don't worry about the "could've....should've....would've" scenarios.
