This has me thinking and I may have to wander down there tomorrow to see if it's true. I truly cannot remember the sign having spanish on it. Perhaps the "51" had me so perplexed I didn't notice...I can't remember seeing it last time either...gotta check that out.

Kauboy, for the most part I agree with you. However, I'd be careful with this one...

Unless something has changed (or I am incorrect), effective notice under Section 30.06 is not required for a 51% establishment.

I need to back up for a moment. I was looking for and found the law pertaining to the 51% sign and this is what it says:
§ 411.204. NOTICE REQUIRED ON CERTAIN PREMISES. (a) A
business that has a permit or license issued under Chapter 25, 28,
32, 69, or 74, Alcoholic Beverage Code, and that derives 51 percent
or more of its income from the sale of alcoholic beverages for
on-premises consumption as determined by the Texas Alcoholic
Beverage Commission under Section 104.06, Alcoholic Beverage Code,
shall prominently display at each entrance to the business premises
a sign that complies with the requirements of Subsection (c).
(b) A hospital licensed under Chapter 241, Health and Safety
Code, or a nursing home licensed under Chapter 242, Health and
Safety Code, shall prominently display at each entrance to the
hospital or nursing home, as appropriate, a sign that complies with
the requirements of Subsection (c) other than the requirement that
the sign include on its face the number "51".

(c) The sign required under Subsections (a) and (b) must
give notice in both English and Spanish that it is unlawful for a
person licensed under this subchapter to carry a handgun on the
premises. The sign must appear in contrasting colors with block
letters at least one inch in height and must include on its face the
number "51" printed in solid red at least five inches in height.
The sign shall be displayed in a conspicuous manner clearly visible
to the public.

(d) A business that has a permit or license issued under the
Alcoholic Beverage Code and that is not required to display a sign
under this section may be required to display a sign under Section
11.041 or 61.11, Alcoholic Beverage Code.
(e) This section does not apply to a business that has a food
and beverage certificate issued under the Alcoholic Beverage Code.


So apparently a hospital can have a 51% sign and it doesn't even have to have "51%" on it at all. Man thats confusing. But section C, stating the sign requirements, still must be met(less the "51%" requirement that hospitals don't need). So it still must be in a conspicuous place, clearly visible, hung at ALL entrances, and meet the size and language requirements. Thats still a lot for them to comply with, but now at least you know what to look for.

So, as I said earlier, if it's not a legit "51%" sign or a 30.06 sign, your free to pass ;-)

Personal note: I just love the law, and hate it with a passion at the same time. I wish I could just cram all of it in my head like in The Matix. That would save me a ton of reading. Could you even imagine trying to find the answer to these kinds of things without the Internet?
