Need some Help have some Q?

#1

Post by zombierider »

I am 28 yrs old when I was 15 I was arrested for burglary of a habitation and two posession of narcotics charges. The narcotics charges were dropped (because they weren't narcotics) but I was put on probation for a yr and a half. The record was sealed but the arrests show up when I get pulled over by a state trooper. I've not gotten in trouble since then other then a few traffic tickets, and one theft by check( I was 19 and didn't know how to balance a checkbook)

My question is will that stuff keep me from getting my chl?
Thanks

I'm not a lawyer but IMO, it shouldnt, as long as the burglary was not charged as a felonious conduct by a minor. The check was almost 10 years ago and was probably a class c misdemeanor.

Options:
Send an email to CHL@txdps.state.tx.us and ask for their advice.
Take a class, appy and wait.
Call an attorney and have him research it for you.

Depends on the amount. Class C theft by check is under $20 iirc. Might be getting confused w/ theft of service...on the phone and not near a penal code book.

I am not sure the amount of the theft by check maybe $20 I just know it cost me around $400 for all the charges and fees I moved and didn't realize I had the charge so I when I found out I had all kinds of fee's added on.

I didn't think that one was a problem. So do you think since my juv record was sealed it's ok.

If you were not certified as an adult, the problems you had as a minor will not disqualify you. I think burglary of a habitation was a felony even 15 years ago, so it would disqualify you for 10 years. As long as the hot check issue was a misdemeanor, it would be disqualifying only for 5 years.

It looks like you are fine.

But disclose everything to DPS, even if it doesn't disqualify you, or your omissions can get you denied.
This will only hurt a little. What comes next, more so.

I am going to have my record pulled so I can give them exact dates cause I want to make sure I do everything right.
I have my chl class in the morning.
