51% sign

51% sign
Just wanted to make sure: does a 51% sign have to be an actual, formal sign to be compliant? Will a copy or hand painted sign on a piece of plywood be compliant?

Re: 51% sign
Legally it should an oroginal or copy. In any case, I am staying away from bars. It is a felony to carry there.

Re: 51% sign
The sign I saw was a hand painted sign. It was at a beach park. They have a stand that sells beer but I doubt that it's an actual 51% location. Most people bring third own.

Re: 51% sign
The requirements for the sign are listed in Texas Government Code §411.204. I don't see any requirement in the law for it to be the sign that TABC supplies as long as it complies with the law.
Contact TABC if you think they have posted a 51% sign incorrectly.Sec. 411.204. NOTICE REQUIRED ON CERTAIN PREMISES.
(a) A business that has a permit or license issued under Chapter 25, 28, 32, 69, or 74, Alcoholic Beverage Code, and that derives 51 percent or more of its income from the sale of alcoholic beverages for on-premises consumption as determined by the Texas Alcoholic Beverage Commission under Section 104.06, Alcoholic Beverage Code, shall prominently display at each entrance to the business premises a sign that complies with the requirements of Subsection (c).
(c) The sign required under Subsections (a) and (b) must give notice in both English and Spanish that it is unlawful for a person licensed under this subchapter to carry a handgun on the premises. The sign must appear in contrasting colors with block letters at least one inch in height and must include on its face the number "51" printed in solid red at least five inches in height. The sign shall be displayed in a conspicuous manner clearly visible to the public.
Re: 51% sign
Just stay away from a 51% regardless. For example, a store that does not derive 51% of its income from alcohol but started a differnt company that they use to buy and sell the alcohol is still required to post a 51%. In other words the business can be under two names but the same establishment and although technically they only sell 10% of their revenue in alcohol they will still be required to post a 51% because the company they are buying and selling it under is 100% alcohol revenue. Stupid I know but it does happen.

Re: 51% sign
I’ve seen this at a hotel. I was carrying at the “free hot breakfast” and noticed the tables and chars for breakfast were the same as the bar. Now I know the hotel can’t possible sell enough booze to off set ½ of the room rate, but I’d not be surprised if it was it’s own entity paying rent to the facility.
The bar was closed so i did not worry about it, but did make note not to eat dinner there, as the bar would be open. I finished my meal, and went on my way.
this was the only time i've been suprized by a 51% sign.
