Post Office Franchise in retail store

#1

Post by coog83 »

Ok, this may be a tricky one, but I haven't found a straight answer yet. Where I work, there is a post office franchise inside of the store. We are not a post office, but we accept packages in a part of the store, where there is a post office window, and once a day, the postal carrier comes by, just like a fedex or ups carrier and picks up the packages. However, no postal employees work in the store. It's simply a store employee who is trained to accept shipments. Does having this franchise in the store make it an off limits area for cc, just as if it were a legitimate post office? There IS a USPS sign next to the door that advertises our shipping services, but there is no sign that designates it as a post office. Any ideas? I'm confused.

I'm no lawyer, but I believe that the post office restrictions apply only to those buildings owned or leased by the federal gummint in which post offices are still located. Since the Postal Service maybe leases a part of the store, but not the whole store; and since the space used is most probably not leased by the federal gummint (the postal service is not owned by the gummint) I would say that you're good to go.

I would think that it's not "federal property". A lot of stores sell stamps, that wouldn't make them a post office either, in my opinion. Particularly if there is not a single "postal employee" assigned to that square footage that is leased.

IANAL, of course, and we all know how the common sense of the law is often skewed by those who enforce/adjudicate/legislate.

As the OP properly pointed out, these are FRANCHISES, meaning privately owned and operated. These new businesses are the USPS' attempt to compete with the UPS Stores, Mailboxes Etc., and other postal/shipping oriented businesses. They are in no way owned or operated by the USPS. The USPS simply sends a driver by the location 1/day to retrieve any packages and mail intended to be shipped via USPS.

Carry away. As a private business they could post 30.06, but I've not seen one in my area posted.

I recommend reading the RFCs if you really want the [non] answer. It is not only limited to places owned or leased by the USPS. But this is the worst of conflicting-rules gray areas. Just don't get caught and you'll probably be fine :thumbs2:

You don't have to go every day now, your plastic is in your hand. It is people like you that slow down the whole plastic delivery process. "rlol" "rlol"

[edit] Forgot the OP. There is a PO in a local hardware store I go to and I don't hesitate to carry in the store.

Thanks for the feedback. I figured it was all good, but I was just curious. I don't currently carry at work anyway, but when I go in off the clock, that's a different story. I just wanted to make sure I was clear. I'm thinking of getting calf/ankle rig for the LCP so I can never be alone. Even the pocket can become a problem when you work retail.

All:

On the very tiny choice that any of us would be "made" by a local LEO
while at a full-fledged post office, would a Texas cop actually be able to
arrest us for carrying in the PO?

IIRC, Texas CHL statutes don't cover FEDERAL property.

So, it follows that an arrest could only be made by some sort of federal LEO.

Comments from the peanut gallery, please.

4th Saturdays: Sunny St. Cafe, off I-20, Exit 415, Mikus Rd, Willow Park.

Responding to 2 posts at once.

SIA: I don't believe Texas LEOs could arrest you for violation of federal law, but they can detain you until feds arrive. Whether they would, or not, is an open question.

Regarding the OP and the statements that it is a gray area from other posters, I don't think so. See the following link for a description of the USPS Partners programs. http://www.texasshooting.com/TexasCHL_F ... =7&t=28535

The one the OP described is the Contract Postal Unit (CPU). These units are located on the private property of another business, not owned by the USPS, not staffed by USPS employees. The RFC simply doesn't apply. If it were a Post Office Express (POE), then maybe the RFC applies, but only to the space leased by the USPS. The rest of the store is open travel. You should verify that it is not one of these units, but a CPU.
