30.06 removed, gone, not there anymore
I took my dad to the doctor the other day in the typical medical building, owned by the hospital group. I've taken him there for the last three years and have always been greeted at the door with a proper 30.06 on the glass door front. White background with red letters, big, noticable, no question.
This time I walked in, looking for it as I always do, and it was gone. I stopped and looked around to see if it had been relocated. No where to be found.
Makes me wonder why? They did some remodeling maybe they forgot to put it back. The doors and the door front look the same and the hardware is worn so I don't think they did anything to that entry. Maybe a worker ran a wheelbarrow through it and when it was replaced they didn't bother to put the sign back up. I don't know. Just struck me as odd. I can't imagine a hospital group would intentionally take it down, assuming they even remember it was there.
Not sure what this means or why I occupied bandwidth to tell you. Just thought I would share.

I'll bet you guesstimate about the glass breaking, and being replaced is accurate. If they never had any problems, then it is quite likely that management hsn't even thought about sticking the letters back up.

That leads me to a question. Since the sign is gone, does that mean that people can not carry in that building? Or since there was a sign is the building still off limits to those that saw the sign? I would hope that it means that the building is now open to carry.

Logically you would have to go with if the sign is currently in place. I wouldn't expect them to post a "CHLs are Now Welcome" sign. It would be reasonable to think it was OK.
Same would go for a business that decides to take their's down. It is no longer posted.
Now, if it was a case of the window getting broken and the sign not being replaced I think you are still covered. You can only go on what is presented before at the time of entrance.
Just to throw in another twist. The back entrance has no sign. I don't know if it ever did or not.
I'll have to take dad in again in a couple of months so I'll check again.

Bottom line...
Shhhhhhhhh...Keep it under your hat...
Go back and look at the code, and see what it says about "hospitals"...
The professional building you took your dad to may not be covered under that provision in the law...I stand to be corrected, but thats ok, I do not go to facilities like that very often, and if I do, I am not in the mood usually to carry anyway (I know, some may be shocked by that revelation )

Especially the part of 46.035 that says "subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor was not given effective notice under Section 30.06"stevie_d_64 wrote:Go back and look at the code, and see what it says about "hospitals"...

Could be that they were recruiting some doctor who has a CHL and he negotiated the 30.06 away.troglodyte wrote:I took my dad to the doctor the other day in the typical medical building, owned by the hospital group. Re: 30.06 removed, gone, not there anymore
"effective notice" being another wide ranging form of exploitation...The sign could actually be non-compliant to the statute, but if the intent is there, "effective notice" is given in the owners opinion...And might not boad well for you as the "testus casus" in a court of law...boomerang wrote:Especially the part of 46.035 that says "subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor was not given effective notice under Section 30.06"stevie_d_64 wrote:Go back and look at the code, and see what it says about "hospitals"...
So until those that are able to post the 30.06 are put on notice to post the sign properly in all aspects of the law, and penalties for non-compliance are levied, then I see this being more of a burden on us...As it always has been...
I think the situation stinks, and this issue has bothered me from day one...
If I were to get elected to office this would be a tweek to the law I would sponsor...Just because...
Just my opinion...

Re: 30.06 removed, gone, not there anymore
My wife suggested that. If so, I would like to know the doctor and go to him/her...of course with my luck it would be an OB/GYNLiberty wrote:Could be that they were recruiting some doctor who has a CHL and he negotiated the 30.06 away.troglodyte wrote:I took my dad to the doctor the other day in the typical medical building, owned by the hospital group. Re: 30.06 removed, gone, not there anymore
The law is very specific about what constitutes effective notice. That notice can be verbal, which means somebody has to tell you specifically that you can't carry (otherwise it's just hearsay) or it can be written. If it is written, it can be on a sign, a leaflet or a card. In any case, written notification must conform to the requirements of the language given in TPC 30.06
