The priors would not come into play...not during the trial at least. Horn...at the time he pulled the trigger had no idea the BGs had priors and therefore I do not think it can be brought in as evidence or as part of a defense. Rule 402 of admissible evidence....i think. It's not relevant because Horn did not know at the time he pulled the trigger.
Actually, reading the not guilty verdict on the cops that shot that wedding day thug, I think you might not be correct.

In closing arguments, defense attorneys accused prosecutors of building their case on the unreliable testimony of Bell's friends. They noted that Guzman and Benefield both have criminal records and $50 million lawsuits against the city.

The pair were part of "a parade of convicted felons, crack dealers and men who were not strangers to weapons," said James Culleton, Oliver's attorney.

With cameras getting smaller, I wonder how long it will be before we start seeing a hangun-mounted camera along the lines of Lasergrips or the LaserMax. It would only need about 30 seconds of video capability in most cases, and could really be nice to have in court...besides providing cool pics for threads like this. "rlol"

Burris Shotcam Digital Camera with Integrated Weaver-Style Mount Matte

The Shotcam is an integrated targeting, illumination and video documentation accessory for firearms. It takes a still photograph at the moment the weapon is fired. This is great for duty officers as it provides documentation of shots fired.

I Love that Story Davemarg

Love this Story, Anytime I see a Black guy, Mexican, start walking my way, I'm getting ready, cuz I know he aint walking over to ask me how my day is going.
I just wonder what the Anti-gun folks response to this story would be?, "Well, you should have called 911 and waited for Police". Ha Ha Yeah Right!!!!. This is one those stories that News Media folks don't dare report, anything concerning a firearm, except something Negative against a Firearm, won't get reported on.

BG didn't sound like he was asking for a Handout to me, he was "Ordering" the Money to be given to him.

. I would be afraid I would be thrown in jail for pulling my gun on a man who was asking for a hand-out.

Criminal Element

I'm just being Honest, My alert Level rises when a Black guy or Mexican approaches, and others do feel the same way, but probably won't mention it here, but I will.
I'm not a racial person, but that's just how I feel, and that's that.

Some of my friends aren't White either, some are Deputies, and they feel the same way. I'm talking about the thugs, like those who walk the streets looking for prey, yes, there are white thugs to.
I've been a victim once of a
black male thug, got beat down, and attempted carjacking by a Mexican.
So again, My alert Level goes up when certain People start walking towards me, you watch their demeanor.

everyone's eyes are white, and that's usually where I tend to look first. that's one place you get a lot of info about a person, too.
FWIW, IIRC, AFAIK, FTMP, IANAL. YMMV.

He took the info of the suspect and Dallas Police found him about a half mile away still flippin out.
What part of Dallas were you in?
I don't pull unless I am going to shoot.
What?? I hope you meant you don't produce your weapon unless you're prepared to shoot. There's a big difference.
I will not risk going to jail, if avoidable, because L.E. doesn't know or care about the law.
What exactly do you mean by this statement?

I've been in situations like this several times in Dallas (off duty) and have done exactly the same thing. If the thug is a true predator and he sees you put your hand back where a gun would be, in most cases he will back off. They want an easy victim. Now if he's not very observant or is high on drugs and is willing to do whatever it takes to score, then it just might take pulling your gun and pointing it at him. If you pull it you'd better be prepared to use it because some criminals will read you like a book. If they don't think you will shoot then they just might call you out and you'd better be prepared.

Not knowing exactly where in Dallas this occurred I can see myself doing just what this fellow did. If I had driven up and witnessed it, based upon this scenario I would have told him he did a good job of protecting himself and his family. I would have arrested the suspect for robbery if the complainant was able to articulate the elements of the crime as he did here.

The majority (large majority) of Dallas Police Officers are fed up with the crime we have and are constantly telling each other that we wish more people would get a gun so as to protect themselves from criminals. Every time some thug is shot by a citizen who they're trying to victimize is a win as far as we're concerned. That's why the CHL and Castle Doctrine laws were written in the first place.

Everyone that steps foot in Dallas should be prepared to defend themselves and not rely on us to do so. 3,200 cops can't be everywhere and watch over 1.2 million people. Once 911 is called we become report takers and fugitive hunters. The odds of us arriving to a location while a crime is still in progress is somewhere between slim and none. And as the old saying goes, "Slim already left town" so in this case you're pretty well on your own.

You'll read or hear about an incident that happened tonight in what we refer to as our NW Division. A delivery driver who has a CHL was jacked up by a thug. Thug went for his gun, CHL holder got to his first. CHL holder is alive and well (as good as can be expected after a shooting) and the thug is in the hospital and might not survive. Again, that's the way it's supposed to work.

I hate to sound racist but Briankey I'm with you on this one. Some one walking around with they're pants down to their knees definately catches my attention as well. I was in a situation (before I got my license and my gun) where I was washing my truck at a car wash place and a somewhat elderly black man (late 50's) asked if he could dry it for a couple bucks, said he was hungry. He seemed harmless so I said sure, as long as we have a deal that you will walk right across the street to that restraunt and get some food. He dries it somewhat okay, no big deal, I hand him his share and I fiddled around and watched him go right where he said he would. Cool right? I felt good. But then this younger black male (25 or so) walks up and just asks for some money. I said no I don't have any more I just gave it to that guy walking across the street. He persists and starts rambling "you sure man", "come on, jus' give me some change, you ain't got no change" and quickly approaches me as I begin to get in my truck. My window was down and as I watched him he was looking in, looking at me, looking inside my door (which is where my wallet usually stays) and gets slightly aggravated. I thought I was going to have to knock him over the head to get him to leave. Since then I haven't given any money out to any one.
