Case dismissed

I was recently arrested on a Case A Misdemeanor and DPS has suspended my LTC. I have requested a hearing for the suspension. The court case was dismissed as no probable cause for the arrest. Do any of the lawyers on here know if I can get the suspension lifted?

I could find it in Chapter 16.

Do you have any carry insurance such as Law Shield, etc... if so then you can try and call them for advise...

I can't say if it is applicable or not after they suspend your LTC but I do know that when you apply for the LTC originally they require you send them the court documents showing dismissed for any charges you may have ever faced. I remember having to do that with three different cases, two were the same event. I would probably call them and ask.

Just curious … since the charge was dismissed, if the DPS refuses return your license, does that fact make you prohibited from Constitutional Carry?

All you have to do is send dismissal & request suspension lift.

That was my thought as well. I don't know why they can find charges on your record but can't find the final disposition. That is what they do on your original application for a CHL/LTC. I had two counts each or AA and AM that were no-billed by the grand jury as self defense. I had to run down to Dallas and get copies of the disposition to send in. Cleared up and everything was a go.

Easy answer: because the counties don’t report the dispositions & DPS has incomplete rap sheets.
