Re: Houston Zoo Reinstalls No Guns Signs
Thank you, Charles. I have been reading and trying to examine the stretch of logic that the Zoo has chosen to hang their hat on. I could not see anything to suggest that they are correct, but IANAL which is why I am glad you chimed in.
Thank you again.
Thank you again.

Re: Houston Zoo Reinstalls No Guns Signs
I wonder who's going to get charged for that violation at the school???? We need the same DA that got the Grand Jury indictment of the Planned Parenthood videographers to tackle this! Not likely, Ha!blackdog8200 wrote:They sell beer and wine at school?

Re: Houston Zoo Reinstalls No Guns Signs
When can we expect the DA to rule on these complaints and start issuing the fines? It's been nearly six months since the law went into effect and we began filing complaints, but I've yet to hear of a single one resulting in a fine.
Zoo IS an educational facility capable of banning guns
With the understanding that:
1. Texas is not Missouri
2. Missouri's Constitution was recently amended to
3. We now have, to the best of my knowledge, the first judicial decision in the country, ruling that a Zoo (in this case, the St Louis, MO zoo) is an "educational facility", and when applying "strict scrutiny" it is permissible for the Zoo to ban guns on its premises.
4. To the best of my knowledge, TX does not have as strong a Constitutional right to keep and bear arms, as expressed by the MO Constitution
5. I understand that the Defendant in that litigation (Zoological Park V Smith) had requested some advice/assistance from here, and was rebuffed.
6. Let us see if Dallas Zoo, Ft Worth Zoo, and Houston Zoo will now attempt to use the (non-binding) precedent that has been established in St Louis.

Article I
BILL OF RIGHTS
Section 23
August 28, 2015
Right to keep and bear arms, ammunition, and certain accessories--exception--rights to be unalienable.
Section 23. That the right of every citizen to keep and bear arms, ammunition, and accessories typical to the normal function of such arms, in defense of his home, person, family and property, or when lawfully summoned in aid of the civil power, shall not be questioned. The rights guaranteed by this section shall be unalienable. Any restriction on these rights shall be subject to strict scrutiny

Re: Houston Zoo Reinstalls No Guns Signs
I sent two freedom of information requests to the Attorney General. One specifically asking for a copy of any replies that the Attorney General made in this or the ft worth zoo cases and then another one for any replies the AG has made to any of the improper 30.06 sign cases.TrueFlog wrote:When can we expect the DA to rule on these complaints and start issuing the fines? I just received notification that no replies have been made. AG hasn't ruled on a single one. Bananas.

I bet if the AG was up for reelection this year, there would have been some movement on his part.
In certain extreme situations, the law is inadequate. In order to shame its inadequacy, it is necessary to act outside the law to pursue a natural justice.

I don't doubt that the AG has yet to rule on any of the 30.06 complaints. The city of Pasadena is no longer prohibiting LTC holders from carrying loaded handguns into the Pasadena Convention center during gun shows. They are behaving as if the AG has ruled against them.

Sorry, there is not a precedence set. The Judge only extended the temporary order that had been issued last June. They still have not made a final ruling on the ability of the zoo to ban concealed and/or open carry.juno106 wrote:

So, there is nothing for the Texas zoo's to even try and hang their hat on yet.

Agreed. I think it's time the GOP started thinking about a replacement strategy for Paxton. These signage issues are slam dunks and there's no excuse for them to be taking so long to get resolved.locke_n_load wrote:If he is not able to perform the duties of his office, then he should be relieved and his subordinate take over.

Think of all of the revenue the state is missing by not taking action and collecting those fines from all around the state.

The danger gone, the trouble righted,
God's forgotten, the soldier slighted.
