Re: Almost went to jail!!!
So when exactly does one cross the line? The signs were clearly not compliant what if it is a hand written note simply stating no guns? Or a picture of a gun with an X through it? Are you required to treat all anti gun signs as if they were compliant? The law needs to work both ways not just a single path. If business owners do not want OC or CC they need to properly post the correct sign.Greybeard wrote:Quote: "Stunts like this are what give a bad name to open carriers. "
Yep, I am with Keith on this one. If you go looking for trouble (or ATTENTION), you CAN find it. Such behavior is NOT representative of the holders I know - or want to be affiliated with.
Re: Almost went to jail!!!
I haven't posted an opinion on this thread but I'll stick to what I said long ago .............there will be a shake out period as everyone acclimates to our restored right . There will be fools giving us a black eye and raising alarm for anti' gun folks . Winning hearts and minds should be our goal with the private sector and live up to the sterling reputation we have as CHL holders having respect for the law . We have made great gains , be patient and more progress will follow .

The laws regarding signs are there to protect not only the business owner but also those who carry. People need to show patience and not force your beliefs on others. Like all these idiots OC rifles around town. All these jackasses are doing is making everything worse.
Re: Almost went to jail!!!
I don't think it was illegal to walk past what looks like an "illegal sign." It then became legal notice when the police told him verbally don't OC. If he decides he will go back and try again if the signs are still there it is a Class A misdemeanor because he received LEGAL VERBAL NOTICE.cbr6864r wrote:So when exactly does one cross the line? So the first time through the doors no law broken (if signs are actually what they appear to be), but he has now been warned verbally. Then he says, Iam going back." Now it is a Class A misdeamnor and deserves to be prosecuted if he returns not because of the signs, but because he was verbally warned.
This is not complicated.

Depends on what type of line you are referring to. I'd say in regards to OC that the stupidity line is crossed when you know that entering a business is going to result in a confrontation but you do it anyway because you "can". Sounds a whole lot like OCT tactics which means it is detrimental to the 2A cause.cbr6864r wrote:So when exactly does one cross the line? The legal line has not technically been crossed unless he follows through on his threat to return.
It is important to remember that "compliant signs" are not the only means the law gives business owners by which to limit carry in their stores. The business does not "need" to properly post if they do not want OC, they can do exactly what this business did which was all perfectly legal and ultimately effective.

Re: Almost went to jail!!!
All of this discussion and angst as a result of a guy that has promoted CC over OC up until he posted this one thread.
Sure would like to see some verifiable info this actually happened. It would be a shame to spend this much time arguing amongst ourselves over a fabrication.

So what if a business has a sign that just says no guns tucked in a corner window? The public should have been educated far better. The irony of these signs is that the ones I have seen have all been on ghetto type gas stations which always get held up. why wouldnt they want legally armed law abiding citizens?jmra wrote: Depends on what type of line you are referring to. It serves no purpose to play lawyer for a business that posts the incorrect sign. If your concealed don't worry about it or leave, if your open cover up or leave. If a business in their foolishness posts anything you can either ignore them and go about your business elsewhere. Carrying openly into an establishment that clearly intends to communicate they don't want to see your gun isn't helping.

I can promise you will go to jail if you do that again. You're grown but this kind of stunt will come back to bite you also hurts open carry folks who have worked hard to get this passed.Shadow41 wrote:Keith B wrote:

Re: Almost went to jail!!!
That is a decision that each individual has to make for themselves, that being said, a "no guns" sign tucked into the corner is a lot different than a 30.07 sign with 1/2" letters.cbr6864r wrote:So what if a business has a sign that just says no guns tucked in a corner window? I have no idea why people oppose legal carry, but actions like that of the OP are going to shut minds instead of opening them.

Re: Almost went to jail!!!
It cant go both ways why not honor their decision illegal sign and all and not even CC if an establishment clearly intends they dont want guns on their property. An example those stupid signs with a picture of a gun and a line through them. My point is there has to be a line the law is beyond clear and the signs are very cheap $15-$30 for window signs. If a business feels so strongly about this they should at least post proper signs...which we should all honor and the police should enforce the actual law.amtank wrote:It serves no purpose to play lawyer for a business that posts the incorrect sign. Now if you have been given verbal notice that is a different story and a whole different issue with all kinds of problems within itself. Example you go into large store lets say walmart an employee tells you to leave but not the manger. Were you given notice? Dont worry im sure we will have a few new case law studies.

The OP was not arrested for this incident because he did not walk past a compliant sign.cbr6864r wrote:So when exactly does one cross the line? The only part I'm still confused about is how a non-employee can give someone oral notification that they are not allowed to carry in a business.

The only part of the story that doesn't make sense was about ordering food and them not cooking it. Lubys is a cafeteria style, you stand in line and order whats infront of you. Since when did they have a menu you ordered from?
