Stupid question... does the law make it unlawful to post a non-compliant mixture of a 30.06 & 30.07 sign like what the FW Zoo has done?

Edit: Answered my own question:

Sec. 411.209. WRONGFUL EXCLUSION OF CONCEALED HANDGUN
LICENSE HOLDER. (a) A state agency or a political subdivision of
the state may not provide notice by a communication described by
Section 30.06, Penal Code, or by any sign expressly referring to
that law or to a concealed handgun license
, that a license holder
carrying a handgun under the authority of this subchapter is
prohibited from entering or remaining on a premises or other place
owned or leased by the governmental entity unless license holders
are prohibited from carrying a handgun on the premises or other
place by Section 46.03 or 46.035, Penal Code.

I went by the Ft. Worth Zoo this morning. They still have three signs that I saw and photographed for the affidavit. The parking entrance just before booth and the Education Center. Both have signs that are not compliant (size and wording - mixed 30.06 and 30.07). The sign just before you enter into the zoo meets size, but not wording (mixed 30.06 and 30.07).

I'll work on getting the affidavit filled out and notarized today and sent ASAP.

Charles, should I send a copy to the Zoo too? :biggrinjester:

Seems to me, if they are mixing in 30.07 wording, it must be a new sign that they intend on keeping up. ?

They can keep it up all they want. It's not legal and I'll gladly walk past it all day long.

My question is if the Zoo defies the City and/or the AG, who pays the fine? Isn't it the City that would be fined? So how does the City force the Zoo to remove the signs if the Zoo won't take them down short of a lawsuit?

The reason I ask is if they are claiming to be a school, amusement park etc. then they might be defiant until forced to comply with the law.

They tell em, "remove the signs or get off our property". No lawsuit needed. I don't think the zoo pays the city any rent or lease, they just get to use the property because it's the nice thing to do.

I just faxed the 411.209 notification to both the Fort Worth City Manager David Cooke and City Attorney Sarah Fullenwider. I'll go by the Ft. Worth Zoo next week and if signs are not gone by the 7th (4th business day), I'll file the Affidavit and documents to the AG.

a Daycare?

So that would mean they carefully meet the employee to child ratios, they carefully meet food allergy precaution rules, toy sizes, etc.

There are many, many rules to follow if you are a daycare. They'd better darn well follow them.

It's almost comical how far they are willing to go in order to enforce their agenda. In the end, it will have been much easier and less costly to simply adhere to the law. Too bad all of this can't be taken into account as a "with prejudice" penalty.

Can you get me the name and fax number that you used? I got pictures today as well. No harm in them getting several of these in the same week.

Next question, I am preparing the affidavit... what did you use as proof that the zoo is owned by Fort Worth? Or have you not gone that far yet, just sent the warnings to the City Officials?
