Dressing rooms?
OK, I searched all over the board and found nothing fitting - maybe I wasn't using the right key words, so if this is a repeat I apologize.
How do you deal with monitored dressing rooms in department stores. Not that I go often, but occasionally the need arises. I can see it now, comeout of the dressing room to armed guards awaiting. I am not comforable with off my person carry and so would likely be IWB as that is what I have been doing thus far. It would also be nice to know how a new garment would conceal before getting it home.
Thanks!

I'm legal and the dressing room is an area where privacy is to be expected so exposing the gun inside the room with no one else present doesn't violate any law.
I'm sure my gun has occasionally been observed by store security in their "perches."
In 38 years of carrying, I've never had an issue, nor do I expect to in the future.

Re: Dressing rooms?
In a closed dressing room, I do not think they are supposed to watching you anyway.
When I have gone, same as Excaliber, I don't worry about it either, I enter the dressing room, pull the weapon from the holster, lay it on a bench, it can't be seen by public, I am good to go.

Re: Dressing rooms?
Thanks
a lifetime ago when I worked there part time, the dressing rooms at a certain department store were monitored by female security staff via the 2 way mirrors. I don't know if men's dressing rooms were or not, as I only got the tour of the lady's side. I kinda figured it was considered "private", but don't want to be a test case after only a couple weeks, LOL!

Divided, I completely understand. Keep asking questions, this forum is amazing with the people on it, they have helped me immensely in my 6 months since getting my CHL and I learn more each and every day

Re: Dressing rooms?

There had better not be someone watching me in there. Serious privacy issues in a place where people are disrobing and privacy is expected, right?

Definition of "concealed" pretty well covers dressing rooms IMHO
Don't leave the dressing room door open.
not openly discernible to the ordinary observation of a reasonable person.

Re: Dressing rooms?
There have been many stories of dressing room cameras and 2 way glass in the past. They really started cracking down on this invasion of privacy so I would hope that the existence is few and far between. If some do exist and they said something about the weapon I would like to see them explain how they saw it.

Re: Dressing rooms?
Tennessee law is very precise on this issue: "Personal observation of dressing rooms, including observation via closed circuit television, two-way mirrors, or other visual devices, shall be limited to observation by a person of the same sex as the person being observed. No observation shall be lawful unless notices are posted in the dressing rooms that monitoring may occur."
I searched the Texas statutes for mirror(s), dressing room(s), fitting room(s), etc and below are the only relevant statutes I could come up with. I don't know how they're generally interpreted. Is loss prevention a valid reason or does it fall under invading the privacy of another? The answer would determine if CCTV or recording is allowed in dressing rooms in TX. Is a store or mall dressing room considered the premises of a public place? The answer to that would determine if one-way mirrors or other direct observation is allowed in store dressing rooms. Anyone have experience in this area? DA, was your store in Texas or another state?
Sec. 21.15. IMPROPER PHOTOGRAPHY OR VISUAL RECORDING.
(a) In this section, "promote" has the meaning assigned by Section 43.21.
(b) A person commits an offense if the person:
(2) photographs or by videotape or other electronic means records, broadcasts, or transmits a visual image of another at a location that is a bathroom or private dressing room:
(A) without the other person's consent; and
(B) with intent to:
(i) invade the privacy of the other person; or
(ii) arouse or gratify the sexual desire of any person...
(e) For purposes of Subsection (b)(2), a sign or signs posted indicating that the person is being photographed or that a visual image of the person is being recorded, broadcast, or transmitted is not sufficient to establish the person's consent under that subdivision.
Sec. 42.01. DISORDERLY CONDUCT. (a) A person commits an offense if he intentionally or knowingly:
(11) for a lewd or unlawful purpose:
(A) enters on the property of another and looks into a dwelling on the property through any window or other opening in the dwelling;
(B) while on the premises of a hotel or comparable establishment, looks into a guest room not the person's own through a window or other opening in the room; or
(C) while on the premises of a public place, looks into an area such as a restroom or shower stall or changing or dressing room that is designed to provide privacy to a person using the area.

Re: Dressing rooms?
I DID IT! I went to a dressing room and did not come out to armed guards, alarms nothing - and I got some new undershirts so my IWB and and don't rub! I guess I will get used to seeing a gun butt sticking out when I look in the mirror, but it still kind of takes me aback, LOL

Re: Dressing rooms?
is it really sticking out, or are you just seeing the very edge of it, and it could (from another's eyes) be just a ruffle in your shirt?Divided Attention wrote:I guess I will get used to seeing a gun butt sticking out

Re: Dressing rooms?
Sorry I wasn't clear... it was when I removed my outer garment to try on a new one that the gun is there like "HOWDY!" otherwise I am comfortable that it is not obvious at all!
