I don't know....I've worn a smart carry...got lost when we moved down here, really want to find it again, anyway, you must be carrying it way higher than I did, when I wore it it was way too low to see anything above my waistband.

Looked at cargo pants, as with most women's pants...small pockets. Ugh! Okay so I read today in Texas Minimum Standards for Licensed and Registered Child Care Homes,
Will update when I get a reply.
I wonder if she gave me permission based on "trained and certified" even though I'm non-LEO. I emailed and asked for clarification. Do NOT want to be shut down due to a high priority violation. Especially with an inspection due in the next month.§747.3505 Are firearms or other weapons allowed at my child-care home?

Division 1, Safety Precautions
September 2003
High (a) Firearms, hunting knives, bows and arrows, or other weapons kept on the premises of a child-care home must remain in a locked cabinet inaccessible to children during all hours of operation, with the exception of law enforcement officials who are trained and certified to carry a firearm and ammunition.
High (b) You must keep ammunition in a separate locked cabinet and inaccessible to children during all hours of operation.

September 2003 it says, therefore preceding the Texas CHL & MPA & a lot of other pro-firearm legislation, so that might be why its not specifically covered there.
Personally, I would keep pushing it, as it is at odds with lots of other current laws, chl included, if they say you cannot.

Okay, after being told it was okay by my particular inspector, I received an email from the supervisor:

I will be contacting a lawyer, I need to find one though that knows Texas Child Care Law as well as Gun Law. I am not a lawyer so I can't intelligently fight this but I do believe it violates - at the very least - the Castle Doctrine.Interesting question. There are a couple of different reasons that law enforcement officials are allowed to carry firearms and ammunition on premises during the hours of operation. (1) Law enforcement officials who are parents of children in care may need to be at the operation to check on their children and/or pick up/drop off their children and not be able to change from a uniform or otherwise secure their service weapon. These parents may also be present to participate in activities such as field trips, parties, etc. (2) Additionally, law enforcement officials may be called to the operation for a law enforcement purpose and would need to be equipped with their service weapon in the line of duty.
While I understand wanting to feel protected, carrying a firearm and ammunition, concealed or otherwise during the hours of operation is not allowed unless the person carrying is a law enforcement officer.

It is your home, and your business. Both are recognized under 46.02 as places where you can legally carry a handgun anyway you please.
I know their argument already... "But Think of the children!"
The counter argument is, Malls and Chuckie Cheeses are filled with children, and it is not statutorily illegal to carry there with a CHL either.
Conversely, ANY of the parents of the children you watch could be legally carrying under CHL when they visit (unless you put up 30.06 signs, which I'm pretty sure you wouldn't

No, and she emailed me form her personal account, assuring me that she believes in Second Amendment Rights and that she would suggest that I contact Kel Seliger and Warren Chisum, to work on getting the rules changed. I am going to call both offices, anyone have any contacts there??

I don't know what type of pistol you have.....but I'm going to go a different direction....instead of carrying in a pocket holster or Smartcarry, I'd lean more toward carrying your pistol in some type of thumbbreak or security holster like a Serpa or a Carry-Lok....

The extra security may put you and the other parents more at ease, and it couldn't hurt on the liability front.
Another idea might be to keep your (semi-auto) pistol in Condition Three (chamber empty, loaded mag) and practice drawing & shooting Israeli-style.
