Will I be denied?

before I go take the chl class and apply for a permit Im wondering if I will be denied based on the following, I have never been denied the sale of a firearm.
charges are by year
1998 possession of marijuana
1999 public intoxication
2000 minor in possession of alcohol
2000 disorderly conduct
and in 2003 unlawful carrying of a weapon which was dismissed and case was closed with no conviction

Two questions:
1) were these merely charges, or were there four convictions?
2) are you clean and sober now?
Legal issues aside, hopefully this was merely a phase in your life and you're done with that stuff. If not, then with all due respect, perhaps carrying a gun around isn't a good idea.

I'm thinking you should be good to go. Class A , B misdemeanors, and disorderly conduct have a 5 year waiting period. You should be clear according to your list.

all were convictions except the unlawful carry, and yes im a different person. I just dont want to spend a bunch of money then be denied. I have been clean and sober for a few years now. I just want to be a lawful citizen.

Good for you. Like lrb111 said, as long as they are all class A or B misdemeanor convictions, you should be good to go, given the amount of time elapsed.

Good for you. Like lrb111 said, as long as they are all class A or B misdemeanor convictions, you should be good to go, given the amount of time elapsed.
Assuming that you eventually do get a Texas CHL, please abide by the rules, regulations, common sense and good judgement. All of our chickens do come home to roost.

First - welcome to the forum; second - when you apply make sure everything (including the last dismissed charge) is on the application; third - you have a history of alcohol, drugs, and gun charges which could come to a bad end should you lapse (seen it happen too many times - it is a deadly mixture); fourth - prove me wrong...! Kudos on trying to correct your mistakes and admitting failures - I noticed immediately you did not whine about how nothing was your fault, you get my respect for that.

Welcome to the forum. A lot of good advice on here so far.
First off, were any of these juvenile convictions? The only issue is if they were, you may have a little more trouble getting the records.
The one that may be an issue is the possession charge. Depending on how much you were convicted of possessing (4oz or greater), it may impact the conviction. The law changed last session and now states that if you have been convicted of a crime that was a misdemeanor, but is now a felony, then you would be ineligible for a CHL.
And, as others have stated, you will need the disposition of all past arrests and convictions, even the one that was dismissed to send a long with your paperwork when you apply.

Many years ago I was not who I am today.
I have been in serious trouble with the law and decided to take the right path and it has paid off.
Whatever outcome happens with your CHL, stay on the highroad.

first off, i commend you for sobering up and getting back on the right track. as others have said, you will need to list EVERY arrest on your application, regardless of whether you were convicted. secondly, try to get notarized documentation for each of the above listed arrests to send in with your other paperwork, it will likely cut down on the processing time. i was arrested (as a juvenile) for possession of marijuana back in 2000. i received deferred adjudication, served 6 months probation, and the charges were expunged. i've yet to hear anything from the DPS on my application, it's been about 3 weeks since i sent in my paperwork and others who've sent theirs in at the same time are already getting their CHLs, but mine is still being held up for the background check. so expect it to take a bit longer for your application to be processed. as long as your possession charge would not classify as a felony today, i wouldn't expect it to be an issue. misdemeanors only disqualify you for 5 years.

Hello I am new to the forum and my situation is like the one that stated this post.I want to get a full background check on myself so I can fill out the paperwork when i apply for CHL.I have recently bought 2 guns from dealers so back ground checks were done but I always was delayed till the legal time they could let me get the weapon.It has been well over 15 years since the charges(In other states)so I can't for sure recall the exact charges.So if anyone can help me I would greatly appreciate it.

Somebody please tell me that I wasn't the only teenager alive that WASN'T smoking pot. I'm really starting to wonder. Was that why all the kids wore sunglasses to class?

not sure about running a background check on yourself, but you will need to know the exact charges and provide as much detail as possible before applying. if you can, obtain notarized copies of the arrest reports as well as court documentation. even if you were arrested for something and the charges were subsequently dismissed, you still have to include it on the application. if the charges are misdemeanors then you should have no problem qualifying for a CHL, although your background check may take a while. mine is being held up because the one time i was arrested and went to court was when i was a juvenile (charges were dismissed and expunged from my record). i haven't heard back from the DPS on whether or not they need additional documentation, but i called a family friend that works at the county courthouse and she told me that juvenile case files are sealed and it would probably take a special court order to release them.
