Address Change

#1

Post by nmartine »

Just moved, have had the CHL for a few months. Question is are you allowed to carry if the address isn't updated on the license...do I have to wait until the new one is mailed to me?

Thanks,
Nick

Good question. I think an address change for your CHL shouldn't take any longer than a change for your DL, but as to whether or not you can carry with an incorrect address on your license...I don't know. You have a 30-day grace period from the date of your change of address when it comes to your DL so I would think you have the same period with a CHL, but I would personally not carry just in case if you're past that 30-day period.
We're about to have a similar situation; my husband just sent off for his CHL and we're probably going to have to get a change of address within a few weeks of getting it (if it's on time, knock on wood!!). Since we know our address in advance and have access to the new home starting now, he'll probably apply as soon as he receives his license even if we're still in the process of moving, just in case it takes longer than expected.

So, to sum it up...I would wait until you have your new license in hand if you're past that 30 day grace period.

Yes, you are allowed to carry while you are waiting on the new license with your correct address IF you are within the 30 changer of address period.

Please be aware that your license is subject to suspension if you do not notify DPS of your address change within 30 days
GC 411.187(3) and fail to return the license with your old address GC 411.187(5)

Good to hear, I've only been moved for a week and have already changed my address online for the DL and the CHL. Thanks for the responses!

Dudley, I assume you are wanting me to quote the Reg, as I stated above: GC 411.187(5)

"Sec. 411.187. SUSPENSION OF LICENSE. (a) A license may be suspended under this section if the license holder:
(1) is charged with the commission of a Class A or Class B misdemeanor or an offense under Section 42.01, Penal Code, or of a felony under an information or indictment;
(2) fails to display a license as required by Section 411.205;
(3) fails to notify the department of a change of address or name as required by Section 411.181;
(4) carries a concealed handgun under the authority of this subchapter of a different category than the license holder is licensed to carry;
(5) fails to return a previously issued license after a license is modified as required by Section 411.184(d)"

I can find nothing in the statutes prohibiting a CHL holder from carrying while waiting on a modified CHL with the correct address, as long as he/she has the original CHL in their possession.

Would a zip code change "only" constitute an address change? Physical address (number/street) is same, just a zip code change!

I would think so. The information on your CHL needs to be accurate to the letter/number. I would go ahead and send in my $25 bucks and get it corrected.

What happens to the old license on a address change. Do you mail it in before the new one arrives hence no CHL?

Once the new CHL is in hand, the old one goes back to DPS (officially). If you call DPS, they are usually happy if you swear to shred/destroy it, so as to not have two of the same types of official identification.
