Requirement to pruchase handgun in Texas as (Conditional) pe
Hello,
I went to a store today in order to inquire about purchasing a handgun.
The sales person stated that I needed to provide:
- 90 days of bills at current resident
- permanent resident card
- texas issued drivers license with current address
I got my DL when I still was on a VISA status, therefore my DL states "Temporary Visitor Status expires XX/XX/XX".
The store clerk said that he coudl not sell me a gun with a DL that states the above.
Nevertheless the TxDP states that with a 2year permanent resident card (status CR6) only a drivers license with expiration date matching to the expiration of the permanent resident card will be issued.
I reserached the internet, but I could not find anything that would verify the above.
I hope anybody here can clarify?
I also assume what applies to purchasing a handgun applies to CHL elgibility.

Regarding the 90 day requirement:
http://www.nytimes.com/2011/12/23/us...zens.html?_r=1" onclick="window.open(this.href);return false;
Quote:
In a letter to firearms dealers on Thursday, the bureau said it would soon drop a regulation that bars the sale of guns to noncitizens until they can document that they have lived in a state for at least 90 days, such as by producing three months of utility bills in their name at a local address.
.....
Quote:
Nonimmigrant visitors to the United States who entered without a visa would still have to meet other requirements to buy a weapon — including establishing that they are residents, such as by obtaining a driver’s license with a local address.
Not sure when this is effective.

I think the key word in your quote above is "soon".Mike1951 wrote:Regarding the 90 day requirement:

I have not received anything from the ATF telling me of a change. First indication shouldbe new forms...
As far as the OP, contact your local ATF office and ask them that question.
I would think that if:
1. your Government issued ID was not expired and showed the current address
2. you can show proof of 90 days residency
You have met the requirements for that part of the approval process.

Even after the law changes, I wouldn't be surprised if some stores still asked for the paperwork. Probably the same stores that run a NICS on a buyer with a CHL.

Well. it's the dealer's choice whether to run a CHL holder or not. If you don't like that the dealer does this, find another one.tbrown wrote:Even after the law changes, I wouldn't be surprised if some stores still asked for the paperwork. What most folks don't realize/care is that if the transfer goes sideways for some reason, it's squarely in the dealers lap. The final decision on completing the transfer is the dealers.
So one of the many questions they'll get from the ATF on a 'questionable' transfer is: "Why did you do this transfer?"

Not necessarily. Texas laws apply for CHL. The ATF doesn't dictate Texas CHL laws, although they like to think so sometimestimf79 wrote: I also assume what applies to purchasing a handgun applies to CHL elgibility.

Hi Tim , just perhaps a few words of encouragement . I am a visa holder and as such a non immigrant alien. I can tell you it is possible to purchase a firearm with the following docs ...... i have purchase 3 already.
Texas DL (mine also says temporary visitor)
Texas Hunting license
I94 Admission card (must be 90 days old at least) ...... this is being review and will soon not be necessary .... the 90 days i mean
Proof of residency .... 90 days of utilities bill or similar
For me it really was simple and painless ........... hope this helps

Same for one who asks for 90 days of bills and other paperwork after ATF doesn't require it.PBratton wrote:Well. it's the dealer's choice whether to run a CHL holder or not. .
I believe the basic political division in this country is not between liberals and conservatives but between those who believe that they should have a say in the personal lives of strangers and those who do not.

Um, the ATF _still_ requires it if you're not a US citizen. They're changing the rule, but it's not official yet. Until then, 90 days of proof of residency is required.Ameer wrote:Same for one who asks for 90 days of bills and other paperwork after ATF doesn't require it.PBratton wrote:Well. it's the dealer's choice whether to run a CHL holder or not. Does anyone have an update on the relaxation of the 90 Day rule for non immigrant aliens ????? I am a non immigrant alien in such a position and have recently obtained my CHL ..... but this (it seems) does not aid my purchases ..... i travel frequently for work and often leave the US for a few days , meaning my I94 card is always changing and the 90 day continuous residence is always interrupted.
Re: Requirement to pruchase handgun in Texas as (Conditional
I think DPS will only issue a CHL to US citizens and foreign citizens who are immigrants. For example, someone with a green card (permanent resident) is eligible, but someone here on a student visa (temporary) is not eligible for a CHL.timf79 wrote:Hello,

No changes yet from the ATF, sorry.
