i have a question, i sent the dps a request for an application packet and it took them a month to send me one. it says on their site if the dps finds you qualified they will send you an application packet. does this mean that the dps already ran a background check on me? it took them long enough to send it. im taking my class in Oct. i just got the packet so i wouldn't have any surprises when i filled it out in class.

I seriously doubt that DPS would start anything without an application that includes all prerequisites; #1 Money, #2 Fingerprints, #3 Class certs, #4 other stuff.

Wouldn't get my hopes up if I were you.

I thought thaey did a cursory check before sending out an app, just to check for something blatant. It keeps from wasting everybody's time.

I suppose its possible, but if true it would be the first time I ever heard of the state trying to make sure we didn't pay them too much.

Here's the relevant law:

GC §411.175. REQUEST FOR APPLICATION MATERIALS. (a) A person applying for a license to carry a concealed handgun must apply by obtaining a request for application materials from a handgun dealer, the department, or any other person or entity approved by the department. The request for application materials must include the applicant's full name, address, race, sex, height, date of birth, and driver's license number and such other identifying information as required by department rule. The department shall prescribe the form of the request and make the form available to interested parties. An individual who desires to receive application materials must complete the request for application materials and forward it to the department at its Austin address. The department shall review all requests for application materials and make a preliminary determination as to whether or not the individual is qualified to receive a handgun license.

My take on this is that DPS sees that you answer the questions, over 21 or active service military, not a felon, not convicted of a misdemeanor in the last five years, etc.

It wouldn't make sense for them to perform a background check at that point, since they are going to do it after you pay the application fee.

This requirement is practically defunct. If you apply online, you answer the questions online; and whether you're eligible is probably determined by a computer program.

If you take a turnkey CHL class, the instructor gives you the application with no participation by DPS.

Just out of curiosity, what is your concern? I just received my license last week after a bit of worrying as well. I had a "colorful" youth and ended up with a deferred adjudication sentance for a felony right after I turned 18. If you fall somewhere in the same boat speak up and I will fill you in on the details of what disqualifies you ( so long as it is not an actual felony conviction!) , or if you would rather it stay private feel free to PM me.

I just renewed my "Texas Emergency Communications Services" card in Austin. Another enity supervised by DPS. While there I asked about the pre-screening on CHL application packages, and yes they do a Wants and Warrents check (state-wide). It was explained to me that at that point in the application process all the address information is CORRECT! So, a great time to serve papers or make an arrest.
