No sir, no vested interest in DPS. By I am familiar with government workers. One quick analogy, I have a good friend who used to gripe and moan about getting license plates at the County Tax Assessors office. My goodness he would whine. Then one day his bride got a job there, and all of a sudden they were the most over worked underpaid government workers in existence. He finally put a name to a face and saw it differently.
But I went back to page one to the author's original intent of this thread. I am wrong. Venting was/is the purpose of this thread.
My apologies. I was just trying to get one or two folks to see it in a different light-thereby having an ah ha moment and relaxing till the LTC arrived. I'm in the wrong place.

I have read the statute and Have seen the references to 60 and 180 days.
I HAVE YET TO SEE where it states that these are Business days.
I have heard that RSD considers it Business days. But can someone point out to me where the statute is referring to business days?
That would help to clarify SOME of the timelines.

Called 5 times today finally got through after 45 min on hold told they received documents. Was also told they are still working on Dec applications.

I keep wondering the same thing as you. This seems pretty obvious to me that the statute is talking about CALENDAR days. I have no idea who purpetrated the "business days" myth. Sounds like and RSD "go to" play when times get tough and they cannot meet their required deadlines. As in - "I know it says '60th day' sir (or ma'am), but what the lawmakers really MEANT to say was 'business' days."Sec. 411.176. REVIEW OF APPLICATION MATERIALS.
(a) On receipt of application materials by the department at its Austin headquarters, the department shall conduct the appropriate criminal history record check of the applicant through its computerized criminal history system. Not later than the 30th day after the date the department receives the application materials, the department shall forward the materials to the director's designee in the geographical area of the applicant's residence so that the designee may conduct the investigation described by Subsection (b). For purposes of this section, the director's designee may be a noncommissioned employee of the department.
(b) The director's designee as needed shall conduct an additional criminal history record check of the applicant and an investigation of the applicant's local official records to verify the accuracy of the application materials. The director's designee may access any records necessary for purposes of this subsection. The scope of the record check and the investigation are at the sole discretion of the department, except that the director's designee shall complete the record check and investigation not later than the 60th day after the date the department receives the application materials. The department shall send a fingerprint card to the Federal Bureau of Investigation for a national criminal history check of the applicant. On completion of the investigation, the director's designee shall return all materials and the result of the investigation to the appropriate division of the department at its Austin headquarters..
Don't get me wrong, I'm only at 52 days myself and many other have been waiting much longer then I. I'm perfectly willing to wait my turn. I'm just thinking that this is a very LOOSE interpretation of the codified statute to me.

I am with 16Adams. I was reading this board back in December and it was fun and entertaining. I know many people are frustrated and want there plastic, but I am really beginning to question why it is so important. I too find the slandering and childish name calling of the staff of the RDS distasteful and uncalled for, they are doing all that they can.
For the most part, expressing my first amendment right, from what I have read here, too many of the posters here are far too hostile, quick tempered and just down right childish to be in possession of a weapon. I hope that everyone gets to go walk through the local Walmart with their firearm, because that is what this is all about.
Take a deep breathe and stop whining.

We've all read the statute and thanks for posting I see your point. Remember the old saying "you can't legislate common sense?" To me it's common sense to count business days. RSD is not open for business on weekends or holidays. The 15-20 places they have to check with by law are not open on weekends or holidays. Therefore to me it's just common sense to only count the days that RSD is working, the myriad of places they are required to contact are open-- bottom line count however you want. But it's been my observation most applications are successfully applied for, investigated and plastic in hand within 60 business days. I'm sure there are exception faster and slower.

16adams, I get your logic and I fully understand RSD got slammed. Yet a handful of us who were all in between 12/22 and 1/1 and have not heard anything yet while people who submitted their apps well after we did have plastic in hand. As of day 72 they have not begun to look at my app. Why would they process apps out of order, regardless of calendar days or business days? Can you understand that angst?

Congrats. Just FYI I got my plastic on either the 8th or 9th business day after I noticed the website change. I'm not sure how long the change had been made as I didn't check every day.
