Only reason I can figure out why he did it is because I cracked my elbow Saturday and my arm was hanging down to my waist and I could not move it and he saw that I was injury and decided to get off and pick on someone with a disability.

Only problem I have is with the above statement. Since I am PERMENANTLY and TOTALLY 100% disabled, I don't think that someone who "cracked" an elbow is going to be labeled as disabled.

And in all the years I have been disabled, I have never had any store employee anywhere "pick on someone with a disability".

There is a very important point forgotten in the situation described in the start of this thread. A 30.06 sign is only required when the notice is written. PC30.06 allows the notice to be given orally by the owner or someone with apparent authority. In this case, the orange vest identifies the person as a person with apparent authority. Cabela's has a policy whereby firearms brought into the store shall be fitted with a gun lock. This applies to all customers exhibiting a firearm. The person at the entrance is to enforce this policy. If that person recognizes or even suspects that the "bag" or in this case a pouch holster contains a firearm, it is his job to intercept it and lock it before it enters the store. The fact that you have a CHL has no bearing if you are recognized or even suspected of carrying a concealed firearm and are given oral notice that you cannot carry. If you have a CHL and are not recognized, you do not have a problem. There was a suggestion of unlawful restraint and to call the PD with the filing of a complaint. I can guarantee, in this case the PD would have been arrested our boy for trespass in failing to depart after given oral notice.

Something to ponder. Cabela's allows CHL carry as long as the CHL carry is unknown. Writing to Cabela's complaining about incidents such as this tempts Cabela's to take the easy way out by posting a 30.06 notice and then no one can carry. As we need to practice shooting to stay proficient, we also need to periodically review the Texas Concealed Handgun Laws to recall what our CHL instructer told us, or may have forgotten to stress.

I don't usually chime in on arguments, but I can see another point of view. When I was younger I worked as a security guard, and as a guard I tried to comply with my orders as thoroughly as possible. I often found out that my desire to do a good job was more than what was wanted. If this "gate Guard" had experience that told him that was a gun pouch he might be inclined to check, I would have. I have been to cabbalas many times and I even asked one time what the sign was for, the manager was emphatic that it was for guns to be taken to the firearms counter to be checked by that department and not required if you do not unholster. I can easily see how a new (new to the "Gate") guard may have interpreted the orders he was given. He will only learn if he is corrected in a polite and respectable manner. I would always suggest you go to the local management first with any employee before going to the top. Sometimes it can hurt our cause (to carry concealed) if we complain about every issue to the "corporate office".

I encountered a couple of potential scenarios at a couple of the local stores. What exactly is the policy on concealed carry into Academy and Sportsman's Warehouse? I read that you have to check the firearm on these forums, but in both cases, I have not seen any signs which require this. Can anyone shed some light on this so that I don't wind up in a situation which may cost me some unnecessary trouble with any management or PD. Thanks.

I may have missed it but I do not believe notice to vacate was given, in fact just the opposite. The employee:

1)Announced to the whole store that he felt there was a loaded weapon, discretion was absent.

2)Demanded to check a concealed weapon, not an unholstered or cased weapon.

3)Stated he would not allow him to "...go anywhere."

Without notice to vacate, he would not have been tresspassing.

I visited Cabelas in Buda this (Sunday) morning to pick up some reloading powder (Hazmat shipping is a killer!) and took the time to examine the signage on the front doors. Only business hours are posted. There were two gentlemen at a table in orange vests past the second set of doors to handle any incoming firearms and they did look over the inrush of customers (from behind their table) entering just as the store opened. Otherwise, I saw no mention of concealed carry one way or another. I carry in a vest due to my very casual attire and they did not give me a second look. I suspect the OP's treatment was specific to the individual he encountered and we all have to remind ourselves to be courteous (not that the OP wasn't!) when questioned and feel free to vote with our feet if need be. I know this is resurrecting an old thread, but since I wasn't licensed at the time, I paid no attention to these things and ran across it while trying to see if anyone had experienced problems visiting Cabelas before I went on my first carry there.

Hmmm. Your situation seems very familiar to a CHL holder in Las Vegas at a Costco when he was confronted about his gun and there were no signs.

It would seem that since you are writing about it, you were luckier.
