Possible Stolen FNH Five Seven

I sold my Five Seven and the purchaser called me and said it never arrived. The FedEx tracking number I have merely shows the shipment was initiated and FedEx claims they never received it. At this time I can only assume the gun was stolen by someone at FedEx because my dealer/FFL said he shipped it. I've used the dealer to ship my guns for a long time and if he said he shipped it then I believe him (although supposedly he doesn't have a receipt and so FedEx basically told him to take a hike). Obviously this issue is not resolved.....


I don't think anyone would be stupid enough to sell it at the Dallas Market Hall gunshow this weekend but just in case, I'm posting the serial number and description.

SERIAL: 386211098
FN Five Seven ODG - case is the newer plastic with sky blue inside, has 3 20-round mags and all the manuals, etc. It is LNIB.

I paid my dealer to ship and insure for $900-$1000 (I always insure guns that I ship). The issue is that the dealer/FFL did not get a receipt and FedEx is saying they never received the package so of course they won't pay for something they say they never got. Something is very fishy. I finally talked to my dealer and he wants to wait until Monday/Tuesday to see if the gun shows up and if not we'll go from there.

My prediction is that I'm going to have to reimburse the buyer and then try to get reimbursed by the dealer since I entrusted the gun with him and paid him to ship/insure the gun. I think the gun is long gone and even though it's the dealer who lost control of it, it just makes me want to throw up thinking one of my guns was stolen. And a Five Seven of all guns!!!!!

The issue is that the dealer/FFL did not get a receipt :oops:
I bet he does next time.
Let us know how it turns out; he may split your costs or something?
Guess you'll know more later, hopefully the buyer will get it and truck was just re-routed for Turkey dinner or something.

You know an odd thing occurs here sometimes.
Stuff shipped to me by UPS or Fedex, complete with tracking numbers ... shows up in my mailbox or the mailman brings it to my door. Other times, the UPS or Fedex guys actually deliver the item. <shrug> Dunno.

Being an FFL myself, I say the FFL that shipped the gun owes you a new FN. It was his responsibility to insure it and get a receipt.

:iagree: You did your part. He shipped a package worth $900, and didn't bother to get a receipt? Sounds like he owes you $900 or a gun.

Well I agree. I'm just hoping it shows up. If not I'll see what the dealer is going to do. He shipped 4 guns for me in the last 2 weeks and it would have to be the Five Seven that was somehow mishandled. I just don't know what to think. In my opinion it would be awfully hard to NOT get a receipt. I have my suspicions of what may have happened but I'll wait and see.

Did you get a receipt from your FFL that he took possession of the gun?

He logged it in his FFL log so it's a matter of record. He always logs it in while I am present.

He acknowledges that he had it to ship. I don't have a receipt,just the log book entry.

Have you reported it stolen yet or contacted the ATF?

Just my 2 cents here, but was the package scanned into the FX system when the driver picked it up? Or does it show it was never picked up, just billing info? How many days has it been since the ship date? I'm just wondering because I do shipping where I work and have seen these kind of things happen before. Sometimes the mystery is solved. Hope it works out for you.

FedEX is showing it was never scanned, that they just received billing info.

My dealer wants to wait until Monday or Tuesday to see if the gun shows up and if not it will have to be reported as stolen to the police and ATF.

The gun was taken to FedEx on Monday Nov 22nd. I am unclear what facility the gun was taken to and am assuming it was a store versus on of those drop boxes. I am also unclear what type service was paid for (i.e. overnight/next day, 2 day or ????). What makes me "wonder" about things is the fact that there is no receipt. That is awfully odd if you ask me.

Hopefully the gun will show up Monday/Tuesday. If not, things may get ugly. Thankfully the gun was logged into the dealer's log but that doesn't make me feel any better.

It was most likely taken to a Fed Ex shipping center. The FedEx Office Stores will not allow gun shipments, also dropping the gun in an unattended box is probably a no no.

If it's logged, I'd say it is on him to replace / refund the pistol.

Sorry to hear about it though...
