Another interesting incident...

If you put yourself in this senario...
And you managed to subdue, restrain and detain the suspect in your home, awaiting the arrival of Lawful Authority...
Would you consider those actions to be appropriate in regards to any considerations in the state of Texas???
Like what was stated in the article...He should be glad he wasn't shot...
Remember what you say here, can and will be used against you in a court of law!

In that situation - gun drawn and intruder in my house charging at me - I would have a hard time believing that I would punch the intruder and not just squeeze one finger. I think that trying to subdue the intruder would place me and my family at significantly greater risk.
Now, if he didn't lunge at me, I would have no problem holding him at gunpoint until the police showed up. I have a cell phone with me at all times for a reason!

Maybe the homeowner didn't want to have to replace the carpet in the son's bedroom ?
Believe it or not , that's runs through some peoples minds if they have time to think about it.
And for the record....
Deadly force should be used as a last resort!

I have to agree with Kalrog on this one. I've got my gun out and he charges me in my own home.... For all I know he's got knife hidden in his hand or something? He's gotta be dangerous/crazy to charge somebody with a gun pointed at him.

I'm with you fellers...
It'd be hard not to shoot...
But is the subduing, restraining and detaining of a suspect (if you manage not to shoot them) a damnable offence against a homeowner, regardless of the method used to succeed in performing those activities...
Before the law gets there (to clean up), and regardless if you are armed or not...

Ted Poe can't help you. He's a congresscritter now. Thing is, he can't sentence any liberals to the hoosegow.

Yeah, but he stopped shooting when he stopped shaking from the stress.

Yeah, but he stopped shooting when he stopped shaking from the stress.

I can't see the perp doing anything but lie still and bleed if El Gato's in the equation...

The license holder was also a corrections officer, and probably not afriad to throw down a good punch.
In THIS scenario, that may have been the best move - if you deal with big violent thugs all day and a little guy comes at you and you can effectively get a good punch in to stop the attack without shooting, take that approach.
Me, I have short stubby arms. They are no good for punching.

The CO has almost certainly never been involved in a shooting of any kind, but has probably been involved in use-of-force in his job. He's been trained and re-trained about what's allowable in his job, and has seen the ramifications when others use force. He's probably never known anyone who had to deal with an off-duty use of deadly force issue (and probably not on duty either, when it comes to deadly force).
And so, there was that moment of hesitation that kept him from shooting. He reverted to training; he was probably reaching for his body alarm, and would have used a fire extinguisher or mop wringer if one had been handy.
Just FWIW, here are the instances where I can use deadly force, as a (federal) CO:
1. To prevent loss of life or grievous bodily injury
2. To prevent escape
3. To prevent destruction of government property that could lead to furtherance of loss of life, grievous bodily harm, or escape
4. To regain control of an institution
