Apparently he learned nothing about assuming things from his time in the USMC.Benjamin said he assumed the rifle was unloaded when it was handed it to him
I have found through a few years of taking training classes that a lot of former/current LEO and military don't necessarily have the best skills or safety habits. Very sad indeed. More than likely he cleared the gun with a magazine inserted and chambered a fresh round and then ejected the magazine. I'm very paranoid about handling "empty" firearms and check multiple times to make sure they are indeed empty.
