A photo or video can not testify. You can't cross examine a photo or video.cb1000rider wrote:I wouldn't think so either, depending on level of disassembly. Photos / Videos work too. Clear opening in the chain of custody and inability to prove condition in which he accepted the rifle.
I'd ignore him.
He's not suing anyone.

You can testify using a photo. You can be cross examined.

It sounds like he broke it when he got home. No amount of photos taken days or weeks later would prove otherwise.

I believe the basic political division in this country is not between liberals and conservatives but between those who believe that they should have a say in the personal lives of strangers and those who do not.

Re: Question on private sale of firearm refund
I'm jumping into this thread late, but here's what it sounds like to me.....
- Others are right....the buyer has no clue that the holes for the A2 front sight pins are normal.
- AndyC's suggestion is right on.
- He found a different rifle somewhere else, for a similar price, more to his suiting, and now he wants to weasel out of the transaction so he can get the other one.

An update...nothing has happened as of yet.. The last time I heard from the buyer was April 17th saying, "I guess you're not going to do the right thing. I'll be filing a lawsuit on Friday."

Sounds like he realized his bluff was not gonna work and dropped it. Or, he found out he was ignorant on the AR and what he was looking at was not an issue and now is too embaraased and not enough of a man to send an email stating he was wrong and apologize.jiannichan wrote:An update...nothing has happened as of yet.. Send him this:
And this:
And this:
And this:
Then ask him, if he's not satisfied, would he like you to invent an entirely new, never-before-seen-or-used barrel/sight system for the AR15, since the standard one is not sufficient to his needs?

Re: Question on private sale of firearm refund
I wouldn't send him anything. If the buyer is stupid enough to take the gun apart and then not know what he was looking at and threaten the seller with a law suit, then he is too stupid to own an AR. If you get anything more from him, then maybe send what TAM sent, but I would let sleeping dogs lie at this point.

Since you haven't heard from him I agree with Keith. Don't stir the pot.

Keep quiet and leave the ball in his court. Chances are that he will go away.carlson1 wrote:Since you haven't heard from him I agree with Keith. Don't stir the pot.

I don't plan on communicating him ever again unless the seller tries and contacts me. When he sent me the text, I basically ignored him and have since. I still have all the texts saved in Google Voice.

Re: Question on private sale of firearm refund
Probably the better policy. Still, you can save copies of those pictures I posted in case he ever gets back to you. IF he threatens more action, you can send him the photos, along with a suggestion that you will countersue him for harassment if he doesn't back off. But otherwise, you're right that it is probably better to let it go.jiannichan wrote:I don't plan on communicating him ever again unless the seller tries and contacts me.
