Purchase Delayed - Please Comment!

#1

Post by kwf2006 »

My sister and I paid for a new gun as a fathers day gift for my dad today. My dad is 74 and his record is clean as a pin. (I ran him when I was a dispatcher.) Also, no alimony, bounced checks, child support, unpaid tickets, school loans etc.

However, after the phone call check came back, they said "delayed" The salesman stated that it happens sometimes but doesnt know why. Is this something that he should be worried about? What could have caused this, it has us irritated and worried! Thank you for any info that you can offer!

Even as a CHL, i got this delayed stuff when buying guns at store.

No sweat and just wait 3 b days and go back.

So long as there haven't been any crime that you commited but you don't know.

Like this one time, they wanted to tow my car because unpaid tickets back in 92, when the closest I ever got to America was the American embassy on the far side of the earth.

As a CHL, there's no reason for the dealer to call NICS. How did you get delayed?

Those are three "ATF days"... ATF says that if you are "delayed" on Monday, then your "three days" are Tuesday, Wednesday, and Thursday, and you can pick the gun up on Friday. And ATF only counts weekdays, so if you're "delayed" on Friday, your "three days" are Monday, Tuesday and Wednesday. Most of us would consider Friday-Thursday to be a six day delay, but ATF says it's only three days.

Go figure.

NICS delays occur when:

1. Your name is in their database,

2. Someone else, whose name is the same as yours, and in the same state, is in the database.

3. The database is unavailable due to a server problem or high use.

Some dealers insist on calling in, even if you have a CHL. Especially if they think there is anything unusual about the sale, such as, when you are buying a gun for someone else.

I would not buy a gun from any Dealer that forces a CHL holder to do the call in.

It is one of our rights and privileges that come with the License and I am not going to give that up.

Me neither .... Well maybe, if it was a real good deal!! If it was a great deal I might even agree to a waiting period!!!1

When I got a delay on my first purchase, the dealer said it's not unusual,
and the reason they gave on the phone was "that they couldn't find me in the system".
When I checked on reasons for a delay by searching the net, I found that people like me (resident aliens) get delayed way more often than citizens.
Of course I was worried sick about it. It was driving me nuts that my gun was at the store (I had special ordered it) but I couldn't have it.
The NICS folks called the dealer back the next day, and I got my gun. So the total delay was about 28 hours.

So, don't worry about the delay... it's just time.

Isn't that a violation of the system rules?

I doubt that would be considered against the rules.

Consider this..........

I know this to be true.........

Irving Police Officers routinely run plates (for no violations) as they cruise around the town. They are checking for previous criminal history and if something comes back interesting, they will follow the car until it makes a mistake or otherwise look at it very closely for lights, inspection, etc......anything at all that they can pull the car over for!

This is "Fishing" in my opinion and I am willing to bet that Irving PD is not the only ones doing this.

Yes, it IS against the rules. Using the TLETS/TCIC system for non Criminal Justice Purposes can result in a HUGE fine for the person doing so AND suspension and/or revication of the person's authority to access the system. It can also cause problems for the agency.

And license plates are not linked to criminal histories. They only show the registered owner and information. Some agencies computer systems will cross reference the plate with warrants, but this is done via the data field in the system and not a result of TLETS. Running random plates is a great way to discover stolen cars and wanted people.

Did you have any problem getting a CHL being a resident alien? My fiance is in the same situation. She has a green card, so that's why I was wondering.

I am a green card holder, and I had no problems getting my CHL - other than forgetting to sign my fingerprint cards

At my CHL class at Bass Pro...they made sure we signed everything. In fact, I got hit in the head by the instructor for not signing something. I think he might have been a SGT in the army or something. I felt like a private going through that class anyway. I'd recommend it though for good information and hardcore gun people.

My fiance's greencard says that she is a french polynesian. She is actually a citizen of Poland and was born in Austria. They made a mistake when they processed it. I guess she might have to change that first...
