I am not a lawyer either, but from what I recall of business law and the UCC, a contract is an offer and an acceptance, for valuable consideration (like money). It does not have to be in writing, and I do not believe consideration has to change hands for it to be binding. Without commenting on this specific situation, I note many hotels may charge cancellation fees.

Charging a restocking fee is one thing, or a fee for a custom built item that they would have difficulty selling to someone else. Neither seems to be the case here. A 20% fee for not going through with an order after they can't be bothered to answer emails seems like a really terrible business practice.
