Section 30.05 Huh...?

Anyone here know much about Section 30.05 such as: Is it still valid?

If so, what's it's purpose given Section 30.06 pretty much does the same job.

Anyone know the answer?

Yes, Texas PC § 30.05 is Criminal Trespass for all people and is still valid. TPC § 30.06 only covers trespass by a CHL while carrying.

Until just this morning, I had no idea that Section 30.05 existed.

You may not have known about 30.05 by section number but I hope you knew trespassing was a crime.

"f) It is a defense to prosecution under this section that:

(1) the basis on which entry on the property or land or in the building was forbidden is that entry with a handgun was forbidden; and

(2) the person was carrying a concealed handgun and a license issued under Subchapter H, Chapter 411, Government Code, to carry a concealed handgun of the same category the person was carrying."
